the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 06 – Weirton District, Hancock County, West Virginia, and more particularly described as follows:
ALL THAT CERTAIN tract or parcel of land situate in the City of Weirton, County of Hancock and State of West Virginia and bounded and described as follows:
Beginning at a point in Lisa Court, which street is shown on a plat of Lynnwood Park Subdivision in Plat Book 5, page 37 and 38 in the office of the Clerk of the County Court of Hancock County, West Virginia, said point being the southwest corner of property owned by the late Thomas Uram and the Grantee herein who was then Elsie B. Uram, said Deed from Tony P. Seliitti, et ux dated November 30, 1964 is of record in the Office of said Clerk of Deed Book 123, Page 143. Said southwest corner of the property hereinafter described: Commencing at said point on Lisa Court thence N. 20 degrees 00′ E. 78.292 feet to a point in Kings Creek; thence S. 87 degrees 49′ 20″ W. 19.221 feet to a point in Kings Creek; thence N. 81 degrees 00′ W. 63.00 feet to a point in Kings Creek; thence N. 81 degrees 00′ W. 63.00 feet to a point in Kings Creek thence S. 45.0 feet to a point; thence N. 89 degrees 00′ W. to a point being the right of way line of Culler Road; thence along the right of way line of Culler Road in an arc in a general southern direction to a point where said Culler Road intersects with said Lisa Court; thence in a general easterly direction along the arc of Lisa Court as shown on the plat of said subdivision to the point of beginning.
ALL that certain tract or parcel of land situate in the City of Weirton, County of Hancock, and State of West Virginia being bounded and described as follows:
BEGINNING at a point being the Northwest corner of lands of Tony P. Seliitti, 10.0 acre tract, and being a point in Kings Creek. Thence by a line in Kings Creek South 87 degrees 49′ 20″ East for 19.221 feet to a point in Kings Creek and also being the place of beginning of parcel about to be described. Thence continuing by a line of Kings Creek, North 87 degrees 49′ 20″ East for 122.538 feet to a point in Kings Creek. Thence leaving Kings Creek and by a line through the lands of the Grantor, South 31 degrees 40′ West for 136.14 feet to a point on the North side of Lisa Court, 45.0 foot right of way. Thence by North side of Lisa Court, and by a curve to the left in a Northwesterly direction. Radium = 425.0 feet, Delta = 11 degrees 40′ for an arc length of 86.539 feet to a point. Thence leaving the North side of Lisa Court and by a line through the lands of the Grantor, North 20 degrees 00′ East for 78.292 feet to the place of beginning, and containing 0.238 acres, more or less.
NOTE: For further information, the above described parcel is also to be known as Lot No. 1, Lynnwood Park, and unrecorded plan of lots, developed by Tony P. Seliitti and land out by General Engineering Company 401 Pennsylvania Avenue, Weirton, West Virginia. This description was prepared by Alvin M. Blumert, Registered Professional Surveyor, Pennsylvania No. S 3301 E.
The parties of the first part further grant unto the parties of the second part a right of way and easement over the following described property which said right of way shall be dedicated as a public street and to be used by the public and is to be known as Lisa Court and is more fully described as follows:
Beginning at an iron pin being the Northwest corner of a 2.40 acre tract conveyed to King Valley Land Company by Deed of Tony P. Seliitti. Thence by a line through the lands of the Grantor, North 34 degrees 38′ 30″ West for 45.0 feet to a point in the lands of the Grantor. Thence continuing by a line through the lands of the Grantor and by a curve to the right, Radius = 150.00 feet, Delta = 78 degrees 00′ for an arc length of 204.204 feet to the P.R.C. of proposed Lot No. 3, Lynnwood Park, a proposed plan of lots as laid out for Tony P. Seliitti. Thence by a curve to the left, Radius + 425.0 feet Delta = 42 degrees 00′ more or less, for an arc length of 311.541 feet, more or less, to a point at Culler Road. Thence South 20 degrees 16′ 30″ East for 49.908 feet, more or less, to a point in the lands of the Grantor an also in Culler Road. Thence continuing by a line through the lands of the Grantor and also in Culler Road. Thence continuing by a line through the lands of the Grantor and by a curve to the right, Radius = 380.0, Delta 39 degrees 15′, more or less, for an arc length of 260.316 feet, more or less, to a P.R.C. in the lands of the Grantor. Thence continuing through the lands of the Grantor and by a curve to the left, Radius + 195.0 feet, Delta + 78 degrees 00′ for an arc length of 265.465 feet to the place of beginning, and being a 45.0 foot right of way to be dedicated for public use, and to be known as Lisa Court.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 100 Lisa Court, Weirton, WV 26062-9661.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
