The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 31, 2005, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 483694, in Book No. 1323, at Page 292, Danny L Sink and Jolene C Sink and Iris E Cozzens did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, NA to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Union District, Wood County, West Virginia, and more particularly described as follows:
Situated in the State of West Virginia, County of Wood and in the District of Union.
Beginning at a point in the center of Old U. S. Route 50, thence N. 28 W. 49 poles to a jack oak; thence S. 33 W. 25 poles to a point on the northerly line of Jones run Road; thence in an easterly direction along the northerly line of Jones Run Road 50 poles to a point in the center of Old U.S. Route 50; thence in a northerly direction along the center line of said Old U.S. Route 50 to the point of beginning.
There is EXCEPTED AND RESERVED from the above described parcel of real property those certain parcels of land shown on the attached plat designated as “J. Yost Lot”, “Payne-Bunner Lot” and “M. Bunner Lot”, the remaining land containing 6 acres, more or less, The said plat may be inaccurate in the location of the westerly line of said three lots, and said line shall be as established in the description of said lots contained in the following deeds: (1) Deed from Norma Fridley and A. Clifford Fridley to John M. Yost and Penny Sue Yost, dated April 21, 1972, of record in the Office of the Clerk of the County Court of Wood County, West Virginia, in Deed Book 598, at page 516; (2) Deed from John A. Bunner and Mabel Bunner to Robert L. Bunner and Rose M. Bunner, dated April 7, 1960, of record in said Clerk’s office in Deed Book 442, at page 26; and (3) Deed from Robert L. Bunner, et al, to Mabel G. Bunner, dated October 9 1967, of record in said Clerk’s Office in Deed Book 538, at page 433.
There is attached hereto and made a part hereof a plat of said tract herein conveyed, reference to which is made for a more complete description of said land; except as hereinbefore noted. Map #: 660, Parcel E 5. Parcel No: 36948. Commonly known as: Rt. 2, Box 199 A, Walker, WV 26180
At the time of the execution of the Deed of Trust, this property was reported to have an address of: RR 2 Box 199A, Walker, WV 26180.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $ 6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
