NOTICE OF SALE
UNDER DEED OF TRUST

Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Barbour County Courthouse, in Philippi, West Virginia, on

October 26, 2022
11:00 a.m.

offer for sale certain property described in that certain deed of trust executed by STEVEN W. HERRON and ANGIE D. HELMICK to Jennifer L. Morgan and Matthew E. Osborne, as Trustees, which deed of trust is dated the 13th day of February, 2018, and of record in the Office of the Clerk of the County Commission of Barbour County, West Virginia, in Trust Deed Book 411, at Page 31; and given to secure Citizens Bank of West Virginia, Inc., the payment of a note therein described.

The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction are all those certain tracts or parcels of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in Valley District, Barbour County, West Virginia, being more particularly bounded and described as follows:

PARCEL ONE: lying on Rockfork of Zebbs Creek adjoining Browning Foy and others, beginning at birch a corner to H. Werner and Roscoe Tallmans 17 acres and running with two of Tallmans lines N 62 1/2 E 33.50 poles to a gum and chestnut; thence S 48 E 26.25 poles to a locust, Rose Wilson, thence S 48 E 26.25 poles to a beech at the creek, thence down the creek, S 40 E 23 poles to a beech, thence N 81 E 8 poles to two beeches supposed to be in Brownings line; thence with the old line S 37 E 68 poles to a locust in John Foys line; thence with his line about 32 poles and same course N 10 W about 88 poles or proper calls Henry Foy to a stake, in Werners line, H. Foys line calls N 10 W 90 poles from the stake corner of John Foys fence, here is a stone, Chestnut oak pointers, thence with Werners line S 73 E 11 poles to the beginning, containing 24.50 acres, more or less. The coal underlying this tract of land is not conveyed hereby, the same having been conveyed to N.T. Arnold in a previous deed.

PARCEL TWO: Beginning at a white oak, corner to lands of L.C. Scick, thence line S 6 W 10, 9.21 poles to a stone S 21 W 26.36 poles to a locust corner of land of Clara Davis, thence with two of her lines N 45 W 5050 26.84 to a black gum stump, S 64 W 30, 33 – to a birch, corner to land of Henry Foy, thence with this line N 10 W 50, 53, 84 poles to a black gum, S 89 E 44 poles to a stone, N 44 E 37, 11 poles to a sour gum and large rock, thence S 29 E 42, 44 poles to a White Oak, S 13 E 35, 5, 39 poles to a maple on edge of the Clift of Rocks, S 29 E 43, 7, 94 poles to the beginning, containing 17 acres, more or less.

And being the real estate conveyed to Steven W. Herron and Angie D. Helmick by Kathy Marie Sample, by deed dated the 7th day of February, 2018, and of record in the Office of the Clerk of the County Commission of Barbour County, West Virginia, in Deed Book 497 at page 227.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
