TRUSTEE’S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 16, 2009, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 594506, in Book No. 1531, at Page 328, Eric N Clark and Jacklyn K Clark did convey unto David G. Palmer, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank Trust National Association, not in its individual capacity but solely as owner trustee for RCF 2 Acquisition Trust c/o U.S. Bank Trust National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Union District, Wood County, West Virginia, and more particularly described as follows:

Situate in the District of Union, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to wit:
TRACT ONE:
Beginning at an iron pipe set in the Northwest corner of United National Bank Riding Master, Ltd., Deed Book 838, Page 73; thence with the west line of said Riding Masters, Ltd., S. 66 00′ E. 1369.5 feet to a Blazed White Oak in the west line of H.N. Nelson, Deed Book 888, Page 123; thence with the line of said Nelson S. 6 00′ W. 568.1 feet to an iron pipe found in the Northeast corner of William D. Richards, III, Deed Book 893, Page 309; thence with the North line of said Richards N. 72 38′ W. 227.52 feet to an iron rod found in the Old Love Hill Road Bed; thence with the said Old Road Bed N. 33 30′ W. 364.17 feet to an iron spike; thence N. 47 30′ W. 412.5 feet to an iron spike; thence N. 71 00′ W. 115.5 feet to an iron spike; thence N. 62 44′ W. 313.4 feet to an iron spike in the center of the New Love Hill Road; thence with the center of said road 38 14′ W. 159.6 feet to an iron spike in the East line of Virgil L. and Alice L. Cunningham, Deed Book 880, Page 883; thence with the East line of said Cunningham N. 5 57′ E. 166.1 feet to the place of beginning, containing 10.94 Acres. TRACT TWO:
Beginning at an iron rod found in the Northeast corner of the Everet E. Green property; thence S 18 E 136.1 feet to an iron rod in the old Love Hill road; thence with old road S 51 41′ E 412 feet to a spike; thence leaving old road N 62 44′ W 313.4 feet to a spike in the center of the Love Hill Road; thence with the center of said road N 38 14′ W 159.6 feet to a spike; thence leaving the center and with the Easterly right-of-way line of said road N. 5 56′ E 116.6 feet to the place of beginning, containing 0.42 acres.
BEING the same real estate conveyed unto Eric N. Clark and Jacklyn K. Clark, Husband and Wife, by a Deed dated January 16, 2009, and to be recorded in the aforesaid Clerk’s Office immediately prior hereto. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 393 Love Hill Rd, Waverly, WV 26184-3445.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
