NOTICE OF SALE OF REAL ESTATE

Notice is hereby given that in accordance with an Order of the Circuit Clerk of Wood County, West Virginia, in the above styled civil action, C. Blaine Myers, Special Commissioner, shall offer for sale at the front door of the Wood County Courthouse, One Court Square, Third and Market Streets, Parkersburg, Wood County, West Virginia, on December 2, 2022 at 10:00 am, certain real property located in Steele District, Wood County, West Virginia, identified as Map 280, Parcel E and more particularly described as follows:

A. All that certain tract or parcel of land situate and being on the ridge between the north fork of Lee Creek and the south fork of Lee Creek in the District of Steele, County of Wood, State of West Virginia, more particularly bounded and described as follows:

FIRST TRACT:

BEGINNING at a black oak corner in the line of GW Lott; thence in a northerly direction nineteen (19) poles to the Ridge Road and a stone corner; thence with said Ridge Road in a northerly direction thirty-four and one-half (34 1/2) poles to a stone; thence leaving said Ridge Road in a westerly direction fourteen (14) poles to a stone in said GW Lott’s line; thence with said line in a southerly direction forty-six (46) poles to the place of beginning, containing 5 acres, more or less.

SECOND TRACT:

BEGINNING at a black oak corner to Sarae Small and Jasper Provance; thence in a southerly direction two (2) poles to a black oak in a line of James Amos; thence with said James Amos line in an easterly direction twenty-one (21) poles to a stake in said James Amos line; thence in a northerly direction fourteen (14) poles to the public road; thence leaving said road in a southwesterly direction nineteen (19) poles to the place of beginning, containing 1 acre, more or less.

Said property was conveyed to Randy Atkinson from RESCAP Securities Holdings, Co., by Loancare, LLC, it’s attorney in fact by Deed dated October 26, 2017 and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1269 at Page 853.
The physical address of the property described above is 1041 California Ridge Road, Rockport, West Virginia.
Said property shall be offered for sale to the highest bidder, subject to confirmation by
Order of the Circuit Clerk of Wood County, West Virginia. A minimum bid of $20,000.00 shall be required. Terms of sale shall be a 10% deposit on day of sale, with the balance to be paid within a reasonable time as determined by the Special Commissioner and purchaser, and as approved by the Court.
The above described real estate will be conveyed with no covenants of warranty and subject to any and all easements, rights-of-way, conditions, covenants, restrictions, exceptions, reservations, leases and other encumbrances which may be a matter of record in the Office of the Clerk of the County Commission of Wood County, West Virginia or visible upon the ground.
In the event a federal tax lien is filed encumbering the property described above, any sale of said property is subject to the right of redemption pursuant to 28 U.S.C.§ 2410, or any other applicable law.
