SPECIAL COMMISSIONER’S SALE OF VALUABLE REAL ESTATE:

The undersigned will offer for sale, by public auction on the 6th day of January, 2023, at 10:00 o’clock a. m., at the front door of the Wood County Courthouse, the following parcel of real estate formerly owned by W.K. and Edith Cale, now deceased, located on Hope Hill Road in Tygart District, Wood County, West Virginia, free of liens and claims, and more particularly described as follows:

DESCRIBED AS TYGART DISTRICT TAX MAP 130 PARCEL “B” .

Being approximately 9.25 Acres (Residue of 31.8 acres =/-) as conveyed to Martha Smith Cale and W.K. Cale as tenants in common by deed dated November 5, 1957, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 416 page 268. Less and excepting the “house lot” more particularly described by metes and bounds in the Last Will and Testament of Walter Keever Cale in Deed Book 61 at page 589.

Terms of sale:

The above property is being sold by the undersigned under the authority of an Order Entered in the Circuit Court of Wood County, West Virginia CA No. 2022-C-131. Terry Pepper et. al. v. Raymond I Cale et. al.. The sale will be free of liens and claims, except for any real estate taxes owed, or to be owed thereon. Provided however, the sale will be subject to any and all rights of way, easements, reservations, and restrictions of record. The undersigned will require a deposit of at least 10% of the purchase price as of the day of sale by good funds. The balance of the purchase price shall be paid within 30 days of sale. In the full purchase price is not timely paid, the deposit will be forfeited as liquidated damages to cover the costs of re-sale. The sale is subject to the final approval of the Circuit Court of Wood County.

However, the purchaser shall bear the responsibility to confirm the accuracy of that information, and any fact or condition that a reasonable survey and/or physical inspection would reveal, including the occupancy and /or eviction of any person from the premises.
