The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 23, 2009, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 623720, in Book No. 1580, at Page 564, Ronald L Stewart did convey unto R. Vance Golden, III, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MEB Loan Trust II, U.S. Bank National Association, not in its individual capacity but solely as trustee to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on March 8, 2023 at 9:30 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Lubeck District, Wood County, West Virginia, and more particularly described as follows:
ALL THAT CERTAIN LOT, PARCEL OR TRACT OF LAND LYING AND BEING SITUATE IN LUBECK DISTRICT, WOOD COUNTY, WEST VIRGINIA, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT IN THE CENTER OF RIVER HILL RIDGE ROAD, A COMMON CORNER TO LAND OF MCATEE AND THE TRACT OF LAND HEREBY CONVEYED; THENCE WITH THE SAID ROAD N. 84-1/2 E. 100 FEET TO A POINT IN SAID ROAD; THENCE S. 11 E. 312 FEET TO A STAKE; THENCE S. 79 W. 241 FEET TO A STAKE IN THE OUTSIDE LINE OF THE TRACT HEREBY CONVEYED; THENCE N. 28 E. 221 FEET TO A STAKE; THENCE N. 10 W. 148-1/2 FEET TO THE PLACE OF BEGINNING, CONTAINING ONE ACRE, MORE OR LESS.
BEING THE SAME REAL ESTATE CONVEYED UNTO RONALD I. STEWART AND PHYLLIS E. STEWART, HUSBAND AND WIFE, BY CARL WAYNE MCKIBBEN AND BARBARA SUE MCKIBBEN,
HUSBAND AND WIFE, BY DEED DATED APRIL 20, 1979, OF RECORD IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF WOOD COUNTY, WEST VIRGINIA, IN DEED BOOK 720 AT PAGE 258. THE SAID PHYLLIS E. STEWART DIED TESTATE A RESIDENT OF WOOD COUNTY, WEST VIRGINIA, ON JULY 13, 2007, AND PURSUANT TO THE SURVIVORSHIP PROVISION CONTAINED IN THE AFORESAID DEED, TITLE VESTED SOLELY IN HER SPOUSE, RONALD L. STEWART, THE GRANTOR HEREIN.
BEING THE SAME REAL ESTATE CONVEYED UNTO GRANTEES BY RONALD L. STEWART, WIDOWER, BY DEED DATED SEPTEMBER 22, 2008, OF RECORD IN THE AFORESAID CLERK S OFFICE IN DEED BOOK 1133 AT PAGE 277.
SUBJECT TO RESTRICTIONS, RESERVATIONS, EASEMENT, COVENANTS, OIL, GAS OR MINERAL RIGHTS OF RECORD, IF ANY.
The Real Property or its address is commonly known as 1252 BLENNERHASSETT HTS, PARKERSBURG, WV 26101. The Real Property tax identification number is 03-140-000D-0000-0000.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1252 Blennerhassett Hts, Parkersburg, WV 26101.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
