TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 29, 2018, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 567, at Page 556, Destry Anderson did convey unto Justin M. Raber, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

April 3, 2023, at 10:04 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beverly District, Randolph County, West Virginia, and more particularly described as follows:

All of those certain tracts of parcels of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate in Beverly District, Randolph County, West Virginia, south of Files Creek, southeast of the Town of Beverly, being more particularly bounded and described as follows, to-wit:

Beginning at a 5/8″ rebar set on the southern boundary of a gravel access road, common corner to Revised Lot 15; thence

N. 88* 14′ 06″ E. 50.89′ traveling with the southern boundary of said gravel access road to a found 5/8″ rebar; thence

S. 87* 34′ 30″ E. 128.32′ travelling with the southern boundary of said gravel access road to a set 5/8″ rebar, common corner to Revised Lot 17; thence

S. 03* 44′ 14″ W. 197.19′ leaving said gravel access road and traveling with a line common to Revised Lot 17 to a 5/8″ rebar set on the northern boundary of a gravel access road; thence

N. 85* 48′ 29″ W. 146.20′ traveling with said gravel access road to a set 5/8″ rebar, common corner to Revised Lot 15; thence

N. 00* 11′ 31″ E. 65.62′ leaving said gravel access road and traveling with a line common to Revised Lot 15 to a set 5/8″ rebar; thence

N. 09* 25′ 18″ W. 126.03′ traveling with a line common to Revised Lot 15 to the beginning. Containing 0.71 acres, more or less.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 16 Taylor Lane, Beverly, WV 26253. We have reason to believe the property has a current mailing address of 318 Taylor Avenue, Martinsburg, WV 26253. The property is being sold based on the legal description, not the mailing address, so buyers should perform their own due diligence.

AND BEING the same real estate which was conveyed to Destry Anderson, by Deed dated June 29, 2018, from Veronica R. Coberly, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 595 at Page 418.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
