NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 20, 2003, executed by Borrowers, Eric W Smith and Toni M Smith, to Richard Pill, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1144, at Page 369. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1405 Minner Street, Parkersburg, WV 26101. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 24, 2023, of record in the Clerk’s Office in Book 2274, Page 419. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

30th day of March, 2023 at 12:45 p.m.

Situate in the City of Parkersburg, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to wit: Situate in and being a part of the southerly portion of Lot 46 of Newberry Subdivision being more particularly bounded and described as follows: BEGINNING at a 1/2″ rebar set in the westerly right of way line of Minner Street, at point where a P.K. Nail at the southeast corner at Lot 46 of Newberry Subdivision recorded in Plat Book 5, Page 68 bears S13*36’00” E 108.00 feet distant; thence N 76*46’00” W 100.00 feet to a 1/2″ rebar (set) set in the common line between Lot 46 and Lot 47; thence N 13*36’00” E 70.00 feet with the common line between Lot 46 and Lot 47 to a 1-1/2″ rebar (set). Said rebar being at the common corner to the Varner tract described in Deed Book 882, at Page 232; thence S 76*24’00” E 100.00 feet to a 1-1/2″ rebar (set) in the west line of Minner Street; thence S 13*36’00” W 70.00 feet with the west line of Minner Street to a rebar set being the place of beginning; containing 0.161 acre (7,000.0 square feet). BEING the same real estate conveyed unto Eric Wayne Smith and Toni Smith, husband and wife, by a Deed dated November 14, 2001, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1033, at page 23. This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title. The Grantors further grant and convey unto the Trustees and to the beneficial owner a purchase money security interest in and to that certain manufactured home to be purchased by the Grantors and located upon the subject real estate, which manufactured home is a 2002 Embassy Clayton Manufactured Home, Serial No. CLR018732TNAB. The Grantors further authorize and direct the beneficial owner to complete the blanks hereinabove when said information becomes available to the beneficial owner, and to re-record this security instrument at that time, and to perform all other acts necessary to perfect its security interest in said manufactured home.

Being the same property conveyed to Eric W Smith and Toni M Smith by the Deed dated November 14, 2001 and recorded in Deed Book 1033 at Page 23 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
