NOTICE OF TRUSTEE’S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Evelyn G. Floyd, to Samme L. Gee and Lew G. Tyree, Trustees dated August 10, 2005, and recorded in the office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 400, at page 25, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated May 31, 2022, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on April 3, 2023 at 10:06 a.m., at the front door of the courthouse of Randolph County, West Virginia, the real estate conveyed by said deed of trust and situate in Leadsville District, Randolph County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was Route 4 Box 298, Elkins, WV 26241 and being more particularly bounded and described therein as follows:

Those certain tracts or parcels of real estate situate in Leadsville District, Randolph County, West Virginia, designated as Lot 14 on a plat titled “Scott Properties, Teaberry Hills Plat #1”, Plat Cabinet B, Slide 28, being more particularly bounded and described as follows:

Parcel One: Beginning at a 5/8″ rebar set on the northern boundary of Logan Drive, 40 ft right-of-way, common corner to Lot 15; thence

N. 11* 58′ 00″ E. 150.61′ leaving said Logan Drive, 40 ft. right-of-way, and traveling with a line common to Lot 15 to a 5/8″ rebar found on the southern boundary of Glenview Terrace, common corner to Lot 13. Said rebar bears 75* 41′ 30″ E 98.31 ft. from a 5/8″ rebar found as a corner to Lot 15; thence

S. 49* 34′ 00″ E. 126.42′ leaving said Glenview Terrace and traveling with a line common to Lot 13 to a 5/8″ rebar set on the northwestern boundary of Brierwood Lane, 30 ft. right-of-way; thence

S. 38* 36′ 00″ W. 92.41′ traveling with the northwestern boundary of said Brierwood Lane, 30 ft. right-of-way, to a set 5/8″ rebar; thence traveling with a curve to the right having the following data:

to a 5/8″ rebar set on the northern boundary of Logan Drive; thence

N 70* 31′ 00′ W. 44.47′ to the beginning, containing 11,553 square feet, more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973, of Dailey, West Virginia, in March, 1998.

Parcel Two: Beginning at a 5/8″ rebar found on the northern boundary of Glenview Terrace (not opened), 25 ft. right-of-way, common corner to Lot 15, Lot 14 and Lot 13; thence

S 11* 58′ 00″ W. 150.61′ leaving said Glenview Terrace, 25 ft. right-of-way, and traveling with a line common to Lot 14 and Lot 15 to a 5/8″ rebar set on the northern boundary of Logan Drive; thence traveling with a portion of a curve to the left having the following data:

Radius = 358.10′
Delta = 01* 26′ 34″
Chord Bearing = N. 70* 57′ 54″ W.

Chord = 9.02′
Tangent = 4.51′

to a 5/8″ rebar set on the northern boundary of Logan Drive; thence

N. 15* 23′ 32″ E. 149.77 leaving said Logan Drive, traveling through Lot 15 to the beginning containing 673.7 square feet, more or less, as surveyed by Kenneth Kelly, Professional Surveyor No. 973, of Dailey, West Virginia.

Being the same parcels of real estate conveyed to Evelyn G. Floyd by Kellie D. Sturdivant by deed dated the 10th day of August, 2005, recorded in the office of the Clerk of the County Commission of Randolph County, West Virginia.

This conveyance is expressly made subject to all prior reservations, restrictions, exceptions, easements, right of way, covenants, conditions and limitations that may be found in instruments of record in the chain of title to said real estate.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of the sale.
