PUBLIC NOTICE WEST VIRGINIA MEDICAID PROGRAM STATE PLAN AMENDMENT REGARDING UPPER PAYMENT LIMITS STANDARD UPDATES Pursuant to 42 U.S.C. c1396a(a)(13)(1997) and 42 C.F.R. c447.205, the Department of Health and Human Resources (“Department”), Bureau for Medical Services (“Bureau”) provides notice of the filing of a state plan amendment (SPA) to implement standard updates to the upper payment limits (UPL) which are paid to certain West Virginia Medicaid provider hospitals pursuant to the state plan. The updates being made have to do with adjustment of applicable years to which the UPL applies and the percentage of the provider tax rate which funds the UPL. This SPA will be effective retroactive to July 1, 2016. There is no expected fiscal impact from this state plan amendment in fiscal year 2017. The SPA and this notice will be available for public inspection in each county office of the Department of Health and Human Resources during normal business hours, 8:30 a.m. to 4:30 p.m., beginning Tuesday, August 30, 2016 through Friday, September 30, 2016, and on the web at: www.dhhr.wv.gov/bms then Public Notices.
