NOTICE
Notice is hereby given that the above-styled matter has been filed in the Circuit Court of Wood County, West Virginia, pursuant to the West Virginia Contraband Forfeiture Act (West Virginia Code 60A-7-701, et. seq.). Any person or corporation having a claim to the hereinafter described property shall, on or before the 30th day of May, 2023 file, in writing, their claim to said property with the Clerk of said Court, which said claim must clearly state the identity of the claimant and an address where legal process can be served upon such person or corporation. A copy of said claim shall be delivered to Patrick O. Lefebure, Prosecuting Attorney, Counsel for Petitioners, at the Office of the Wood County Prosecuting Attorney, Judge Donald Black Annex, 317 Market Street, Parkersburg, West Virginia 26101.
Pursuant to West Virginia Code 60A-7-705 (c)(1-6), the following information is given: (1) the property seized which is the subject of the petition filed is $2,030.00 in United States Currency. The 2011 Nissan Rogue, VIN JN8AS5MV2BW264617, is subject of the facts in this matter, but has not yet been seized; (2) the Parkersburg Police Department is responsible for the seizure; (3) the property was seized on January 27, 2023 at 13th and Plum Streets, Parkersburg, Wood County West Virginia; (4) the only owners of the property subject to forfeiture known to Petitioners is Jamil A. Cabral, whose address is 1457 19th Street, Parkersburg, West Virginia and Lyndia Opitz, whose address is 206 Ivy Street, Parkersburg, West Virginia; (5) the person having possession of the seized property at the time of the seizure was Jamil A. Cabral and Lyndia Opitz; and (6) a request to the above named Court to enter an Order directing ownership of said property in the State and the Parkersburg Police Department will be made.
