NOTICE OF PUBLIC HEARING
PROPOSED SEWER AND WATER RATE INCREASE FOR
CLAYWOOD PARK PUBLIC SERVICE DISTRICT
The Wood County Commission will be holding a Public Hearing on Monday, May 18, 2023 at 10:15 A.M. in the Fort Boreman Room of the Judge Donald F. Black Annex located at 317 Market Street, Parkersburg, WV. The Wood County Commission will discuss proposed water and sewer rate increases requested by both the Lubeck Public Service District and the Claywood Park Public Service District.

NOTICE OF PROPOSED CHANGE IN WATER RATES
The board of the Claywood Park Public Service District (“District”) has on April 11, 2023, determined that the District’s water system is in financial distress for failing to meet the statutory cash working capital reserve fund requirement, approved the Dutch Ridge Water System Improvement Project (“Project”), and approved a two step increase in rates for water service, with the first 4.5% step increase to all rate schedules to enable the District to meet the statutory cash working capital reserve fund requirement; and the second step to go into effect upon substantial completion of the Project, a 2.24% increase to all rate schedules except the District’s sale for resale customers who will not benefit from the Project, to pay increased debt services expense related to the Project.
The approved increased rates have been forwarded to the Wood County Commission for its consideration pursuant to W.Va.Code §§ 16-13A-9(a)(2)(E) and 24-2-11. The Wood County Commission has until May 27, 2023 to approve, modify, or reject the increased rates. If the Wood County Commission takes no action by May 27, 2023, the District Board approved rates will become effective for all service rendered after May 27, 2023 by operation of law. The District has asked the Wood County Commission to make the increased rates effective immediately following approval by the Wood County Commission. The District provides water service to over 3,900 customers in Wood and Wirt counties.
The District board approved step one rates are projected to generate only $782 annually in unrestricted cash on $3,316,791 of operating income, and the step two rates will generate only $671 in unrestricted cash annually on $3,365,752 of operating income;

be billed in the same manner as any other family or business unit.
(I,C) TAP FEE
The following charges are to be made whenever the utility installs a new tap to serve an applicant.
A tap fee of $100.00 will be charged to any customer applying for service before construction is completed adjacent to the customer’s premises in connection with a capital project. This pre-construction tap fee will be invalid after the completion of construction adjacent to an applicant’s premises that is associated with the capital project.
A tap fee of $500.00 will be charged to all customers who apply for service outside of a
capital project for each view tap to the system.
CHARGE FOR RECONNECTION ($30.00)
Whenever the supply of water is turned off for violation of the rules, and regulations, nonpayment of bills, or fraudulent use of water, the District shall make a charge of $30.00 for reestablishing service.
DELAYED PAYMENT PENALTY
The above tariff is net. On all accounts not paid in full when due, ten percent (10%) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate.
ADMINISTRATIVE FEE
In the event the District collects payment in full of a delinquent water bill at the customer’s
premises in lieu of a discontinuance of service for nonpayment, an administrative fee of
$25.00 shall also be collected in addition to the delinquent water bill.
RETURNED CHECK CHARGE
A service charge equal to the actual bank fee assessed to the water utility up to a maximum of S25.00 will be imposed upon any customer whose check for payment of charges is returned by the bank due to insufficient funds.
LEAK ADJUSTMENT RATE
(I) $2.00 per 1,000 gallons is to be used when a bill reflects unusual consumption which can be attributed to eligible leakage on customer’s side of the meter. This rate shall be applied to all consumption above the customer’s historical average usage.
SECURITY DEPOSIT
A deposit of $50.00 or two-twelfths (2/12ths) of the average annual usage of the specific applicant’s customer class, whichever is greater.
METER TESTING
Any customer may request in writing a meter test for the accuracy of their meter. The customer shall first deposit $40.00 for the removal and testing of their meter, either by the utility or an independent certified meter testing facility. If, when tested, the meter is found to be more than two percent fast, the amount advanced shall be promptly refunded to the customer. If the meter is not found to be more than two percent (2%) in error, the utility shall retain the amount advanced by the customer for the test. The customer or their representative may be present during the testing.

The Wood County Commission will consider adopting, rejecting, or modifying the District board approved rates and whether to waive the 45 day waiting period for the rate change to go into effect, at the May 18, 2023 meeting of the Wood County Commission, which will be held at 10:15 a.m. at the offices of the Wood County Commission, #I Court Square Parkersburg, WV 26101. The meetings of the Wood County Commission are open to the public.

NOTICE OF PROPOSED CHANGE IN SEWER RATES
The board of the Claywood Park Public Service District (“District”) has on April 11, 2023, determined that the District’s sewer system at its current rates cannot meet the statutory cash working capital reserve fund requirement, approved the Community Acres Sewer System Improvement Project (“Project”), and approved an 11% across the board increase in rates for sewer service.
The approved increased rates have been forwarded to the Wood County Commission for its consideration pursuant to W.Va. Code §§16-13A-9(a)(2)(E) and 24-2-11. The Wood County Commission has until May 27, 2023 to approve, modify, or reject the increased rates. If the Wood County Commission takes no action by May 27, 2023, the District Board approved rates will become effective for all service rendered after May 27, 2023 by operation of law. The District has asked the Wood County Commission to make the increased rates effective immediately following approval by the Wood County Commission. The District provides sewer service: to over 3,900 customers in Wood and Wirt counties.
The District board approved rates are projected to generate an annual unrestricted cash surplus of only $4,986 on $1,561,761 of annual revenue.

APPLICABILITY
(C) Applicable within the entire territory served, except Spring Valley Home Owners Association until completion of the Spring Valley project, at this time former Spring Valley Home Owners Association customers will become District customers subject to the rates and charges below.

AVAILABILITY OF SERVICE
Available for general residential, commercial, industrial, public authority and sale for resale sewer service.

(I) RATES (Customers with metered water supply)

Service Charge $20.22 per month
Commodity Charge $ 13.11 per 1,000 gallons of water usage
Sludge Fee $349.97 per 1,000 gallons

(I) FLAT RATE CHARGE (Customers with non-metered water supply)
Equivalent of 4,500 gallons of water usage — $79.22 per month.

(I) MINIMUM CHARGE
No bill will be rendered for less than $20.22 per month.

$4.00 per 1,000 gallons is to be used when a bill reflects unusual consumption which can be attributed to eligible leakage on customer’s side of the meter. This rate shall be applied to all such consumption above the customer’s historical average usage.

A service charge equal to the actual bank fee assessed to the water utility up to a maximum of $25.00 will be imposed upon any customer whose check for payment of charges is returned by the bank due to insufficient funds.

(I)SURFACE OR GROUND WATER SURCHARGE
An additional amount shall be charged where surface or groundwater is introduced into the sanitary system where evidence of a violation exists. Surcharge formula to be applied in cases where surface drainage is connected to the utility’s sewer system.

APPLICABILITY
Whenever the utility has discovered that customer’s roof drain, downspout, storm sewer or similar facilities conducting surface water have been connected to the utility’s sewer system and such customer has failed to make appropriate action within thirty (30)days of receipt of a demand by the utility to eliminate such connection, a surcharge will be imposed upon the customer calculated on the basis of the following formula:

S = A x R x o.0006233 x C

S = The surcharge in dollars
A = the area under roof and/or the area of any other water collecting surface connected to the sanitary sewer, in square feet.
R =The measured monthly rainfall, in inches 0.000623 = A conversion factor to change inches of rain x square feet of surface thousands of gallons of water.
C = The District’s approved rate per thousand gallons of metered water usage.

The utility shall not impose the surcharge unless and until the customer has been notified by certified mail, return receipt requested, or by hand delivery, that it has been established by smoke testing, dye testing, or on-site inspection that rain or surface water is being introduced into the sanitary sewer system at the customers location, and that the customer has not acted within thirty (30) days from receipt of such notice to divert water from the sanitary sewer system. The surcharge shall be calculated and imposed for each month the condition continues to exist. Failure to pay the surcharge and/or correct the situation shall give rise to the possible termination of water service in accordance with the rules and regulations of the Public Service Commission of West Virginia.

Applicable to the Spring Valley Home Owners Association until completion of Phase I of the Spring Valley sewer project

MINIMUM CHARGE
