Defendants.
The object of this action is for this Court to determine the Petitioner’s right to condemn and appropriate for said public purpose the land indicated and described herein; that the Court will permit said land sought to be condemned to be at once entered upon, possessed, appropriated and used, for the purposes stated in the Petition; that Commissioners be appointed to ascertain a just compensation to the owner or owners thereof, and other persons (lienors or otherwise) interested therein, for such land herein described and proposed to be taken, appropriated and used, for the public purposes and uses, aforesaid, together with damages, if any, to the residue of the respective tracts from which the said parcels sought to be acquired are respectively taken, beyond all benefits, if any, which may be derived in respect to such residue, for the purposes to which the parcels are to be taken, appropriated and used; that such other and further proceedings may be had in the premises as shall conform to the law, and that upon the payment of the compensation and damages thus or to be ascertained, a right of entry be issued; that land, may be vested in the Urban Renewal Authority of the City of Parkersburg, a public corporation, and that Petitioner may be granted such, other, further, general and special relief in the premises as shall seem meet and proper to this Honorable Court.
The parcel of land subject to this proceeding is more particularly bounded and described as follows:
Situate in the City and District of Parkersburg, Wood County, West Virginia, commonly known as 318 5th Street, and more particularly described as follows:
BEGINNING at the corner formed by the intersection of the new southwest line of Fifth Street and the Southeast line of Phillips Court Alley in the City of Parkersburg, Wood County, West Virginia being the northwest corner of the two story brick building located at 318 Fifth Street, known as the Telephone Building, thence leaving Fifth Street and running in a southwest direction with the southeast line of Phillips Court Alley a distance of 85.246 feet to a point located in said southeast line of Phillips Court Alley and at the southwest corner of the said Telephone Building, thence leaving Phillips Court Alley and running in a southeast direction towards Avery Street and with the rear line of said Telephone Building, a distance of 20 feet to a point located 85.00 feet from said southwest line of Fifth Street, thence continuing in a southeast direction towards Avery Street, with the rear line of the Telephone Building, a distance of 25 feet to a point located 85 feet from the southwest line of Fifth Street and also being the southeast corner of the Telephone Building, thence running in a northeasterly direction in a line parallel to and 45 feet equidistant from said southeast line of Phillips Court Alley, a distance of 85 feet to the said southwest line of Fifth Street, being the line of the offset in said Telephone Building, in a southeast direction, a distance of 0.04 feet to an offset corner of said Telephone Building, thence continuing with the southwest line of Fifth Street, being the north line of said Telephone Building in a northwest direction, a distance of 19.56 feet to the Place of Beginning Being the same property outlined in red on that certain map made by L.G. Merrill, Registered Professional Engineer, dated June 7, 1950 a copy of which is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book No.333, at page 484, and BEING the same lot an interest in which was conveyed to Larry Hildebrand and Carol J. Hildebrand, husband and wife, by Get Crafty Inc., a West Virginia Corporation, by deed dated the 13th day of May, 2019 and recorded in the aforesaid Clerk’s Office in Deed Book No. 1302, at page 644

It appearing by Affidavit filed in this action that the last known address(es) for Defendant Larry and Carol Hildebrand, City of Parkersburg, Sheriff of Wood County, Melvin L. Romeo, William H. Edmonds, Parkersburg Locker Room Inc., US Attorney for Southern District of West Virginia, Attorney General of the United States, State of West Virginia Tax Department, Internal Revenue Service, C. Blaine Myers, Trustee, David G. Palmer, Trustee and for any unknown person(s) who may have an interest are unknown and that no other address(es) of residency(ies) are known, it is hereby ordered that Defendant(s) Larry and Carol Hildebrand, City of Parkersburg, Sheriff of Wood County, Melvin L. Romeo, William H. Edmonds, Parkersburg Locker Room Inc., US Attorney for Southern District of West Virginia, Attorney General of the United States, State of West Virginia Tax Department, Internal Revenue Service, C. Blaine Myers, Trustee, David G. Palmer, Trustee and any unknown person(s) serve upon Robert K. Tebay III, Assistant City Attorney, City of Parkersburg, whose address is Post Office Box 1627, Parkersburg, West Virginia, 26102, an Answer, including any related counterclaim or defense you may have to the Petition filed in this action on or before the 29th day of June, 2023. If you fail to do so, thereafter judgment, upon proper hearing, may be taken against you for the relief demanded in the Petition.
A copy of said Petition can be obtained from the undersigned Clerk at her office.
