ADVERTISEMENT TO BID

Sealed bids for the Town of Mill Creek Water Storage Tank Replacement Project will be received by the Town of Mill Creek Municipal Water Department, PO Box 128, 135 Woody Simmons Drive, Mill Creek, West Virginia 26280 until 2:00 PM, L.P.T., on June 28, 2023 for furnishing labor and materials and performing all work set forth in the Advertisement to Bid, Information for Bidders, Bid Form, General Conditions, Supplementary Conditions, Specification Special Conditions, Technical Specifications and Plans (Drawings) prepared by Potesta & Associates, Inc., and all addenda issued prior to receipt of Bids. Immediately following the scheduled closing time for the reception of bids, all proposals which have been submitted in accordance with the conditions of this project will be publicly opened and read aloud.

The Work to be bid upon is generally described as follows:

* Installation of a new water storage tank.
* Demolition of existing water tank.
* Approximately 300 linear feet of 8-inch PVC water line.
* Other water line components.
* Installation of a second high service pump at the WTP and provision of a spare pump, and associated electrical improvements.
* Installation of a new telemetry system.
* Construction time limit for Contract is 365 consecutive calendar days.

Contract documents may be obtained at Potesta & Associates, Inc. (POTESTA), 7012 MacCorkle Avenue, SE, Charleston, West Virginia 25304, telephone number (304) 342-1400, upon payment of $50 for electronic copy or $150 for each set of hard copy documents. If paying by check, make check payable to Potesta & Associates, Inc. If paying electronically, call Potesta & Associates, Inc. at the above number and ask for the accounting department.

Information for Bidders and Form of Proposal will be furnished upon request.

The two envelope system will be used for bidding this project. Envelope No. 1 will contain the required bidder information as outlined in the Contract Documents. Envelope No. 2 will contain the Form of Proposal only and be separate from Envelope No. 1. The two envelopes shall be held together with clips or rubber bands. Both sealed envelopes containing the Bidder Information and Form of Proposal must have the following information clearly printed or typed on the front lower left hand corner of each envelope.

ENVELOPE NO. 2:

Form of Proposal: Submitted by: (insert name and address of bidder).”

Envelope No. 1 will be opened first and the Bid Bond, Power of Attorney, Certificate of Compliance and other pertinent and required documents will be checked to make sure that all documents are in order. If the documents are found to be in order, Envelope No. 2 containing the Form of Proposal will then be opened and publicly read aloud. If the documents from Envelope No. 1 are not in order, Envelope No. 2 containing the Form of Proposal will not be opened and the bid will be considered non-responsive and will be returned to the Bidder.

The successful low bidder will be provided four (4) complete sets of plans and specifications at no additional cost after the contract has been signed. Any additional plans or specifications that are requested will be provided at a cost of seventy-five dollars ($75.00) for each set of plans and seventy-five dollars ($75.00) for each set of specifications. Payment by either cash or check must be made upon delivery.

A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids.

Bids shall be accompanied by a certified check or bid bond payable to Town of Mill Creek Municipal Water Department in an amount not less than five percent (5%) of the base bid.

A mandatory Pre-Bid Conference will be held at the Maxwell Community Center at 103 Hamill Road, Mill Creek, West Virginia 26280 on June 9, 2023 at 1:30 P.M.

Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.

Town of Mill Creek Municipal Water Department reserves the right to reject any and/or all bids.

Prospective Bidders are advised that the contract awarded under this bid is to be funded in whole or in part by the West Virginia Infrastructure and Jobs Development Council.

Bidders must comply with the President’s Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, Section 3 Segregated Facilities, Section 109 and the Contract Work Hours Standard Act.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed or national origin. Federal Law prohibits discrimination on the grounds of race, color, national origin, religion, age, handicap and sex in this project. Minority firms are particularly encouraged to participate.

Bidders must comply with the requirements and policies as outlined in EPA SAP Grant Contractor Cross Cutter Assurances Certification.

Bidders must comply with Disadvantaged Business Enterprise utilization or EPA Federal Regulation 40 CFR Part 33 – Procurement Under Assistance Agreements stated that loan recipients and Contractors must comply with the six affirmative steps as outlined on 33.240 and any other requirements of the state.

“DBE REQUIREMENTS”

Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The Bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.

The Bidder agrees to make “good faith efforts” to subcontract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the Bidder in the execution of the work under this contract.

“NONDISCRIMINATION IN EMPLOYMENT”

“Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.”

Bidders are required to have West Virginia Contractor’s license per Section 21-11-11 of the West Virginia code.
