NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property, is hereby given pursuant to and by virtue of the authority vested in the Trustee(s) by those certain deeds of trusts dated June 7,2016, made by MICHAEL WOODDELL, to Frank P. Bush, Jr, Trustee of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 546, at page 68 and further said deed of trust dated the 5th day of April, 2023, made by MICHAEL WOODDELL, to R. Mike Mullens, Trustee, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 627, at page 384. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will offer for sale at public auction the following described property to the highest bidder at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on:

THURSDAY, JULY 20,2023, at 10:00 AM

The property is described as all those certain tracts or parcels of real estate, being designated as Lot 1, Lot 2 and Lot 3 of the Cheat River Acres, situate in Beverly District, Randolph County, West Virginia, being more particularly bounded and described as follows:
TRACT ONE:
All those certain tracts or parcels of real estate being designated as Lot 2 and Lot 3 of the Cheat River Acres Subdivision, situate in Beverly District, Randolph County, West Virginia, and as shown upon a map of said subdivision recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 251, at page 434.

TRACT TWO:
All that certain tract or parcel of real estate being designated as Lot 1 of the Cheat River Acres Subdivision, situate in Beverly District, Randolph County, West Virginia, and as shown upon the revised map of said Subdivision recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Plat Cabinet B, Slide 17.

Subject to those certain covenants and restrictions as set forth in deed dated March 15,2012 and of record in Deed Book 561, at page 219.

TOGETHER WITH any and all rights of ways for the purpose of ingress, egress and regress to access the property herein conveyed.

Subject to any and all covenants, restrictions, reservations, rights of ways, exceptions and/or easements set forth in the chain of title to said real estate, including utility rights-of-way.

AND BEING the same real estate as conveyed unto Michael Wooddell by Michael Wooddell by confirmatory deed dated March 15,2012 and of record in Deed Book 551, at page 219.

TERMS OF SALE;
1. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, assessments, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions, of any nature whatsoever, of record in the Clerk’s office or affecting the subject property.
2. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
3. The Trustee reserves the right to reject any and all bids received and continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
4. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
5. The total purchase price is payable to the Trustee by certified or cashiers check within fifteen (15) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by certified or cashiers check.
