CONTRACT

Sealed proposals for the Ritchie Elementary School Renovations, Testing, Adjusting, and Balancing Contract will be received and logged by the West Virginia School Building Authority and Ohio County Schools, 2203 National Road, Wheeling, WV 26003 on Monday, October 3, 2016 at the office of the Assistant Superintendent of the Ohio County Board of Education 10:00 a.m. local time. All Bids will be publicly opened and read aloud shortly thereafter at the Ohio County Board of Education Meeting Room, 2203 National Road, Wheeling, WV 26003.

The HVAC Testing, Adjusting, and Balancing (TAB) agent shall be certified according to the procedures contained in the Associated Air Balance Council National Standards, the National Environmental Balance Council National Standards, the National Environmental Balancing Bureau procedural standards, or the Environmental Engineering Consultants standards for testing, adjustment and balancing of HVAC systems. The scope of services is defined in Ritchie Elementary School, Project Manual, Section 230593 – Testing, Adjusting, and Balancing.

Copies of the Bidding Documents will be available on or after Monday, September 19, 2016 at the office of the Architect, M&G Architects & Engineers, at the address noted below, upon payment of a deposit of $50.00 per set. The deposit will be refunded if the bidding documents are returned in good condition within ten days following receipt of bids. Electronic Portable Document (.pdf) format documents will be available upon payment of $50.00 per set, which is non-refundable. All bids must be submitted in accordance with the requirements listed in the bidding documents to be considered valid.

A satisfactory Bid Bond executed by the Bidder or an acceptable surety in an amount equal to 5{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the bid shall be submitted with each bid. The successful Bidder will be required to furnish and pay for a satisfactory 100{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} Performance Bond and Labor and Material Payment Bond in the amount of the contract price.

The bidder(s) submitting the lowest qualified bid(s) as determined by the results of the bid opening shall submit a listing of all subcontractors and all major equipment and material suppliers proposed for each major branch of work itemized and described in the contract documents for the project.

Bidders shall reference the Project Manual for all required Bidding Documents to be submitted as a part of a complete bid.

Each Bidder must insure that no employees and applicants for employment are discriminated against because of race, creed, color, sex, or national origin.

Bids may not be withdrawn for a period of 30 days without the consent of the Owner.

Contractors shall comply with all applicable National, State, and Local codes.

Pursuant to Chapter 21, Article 11 of the “West Virginia Contractor Licensing Act” of 1991, all Contractors doing business in West Virginia must be licensed to perform work in the State; the Contractor’s WV License number must be affixed to all submitted construction bids and fully executed and binding construction contracts or agreements.

Ohio County Schools reserves the right to reject any and all bids, to waive all formalities, and to make selections from the bids that are solely in the best interest of the school system.

Ohio County Schools will suffer loss if the project is not completed within the Contract Time. Therefore, as liquidated damages, and not as a penalty, the Contractor shall be liable for such damages at the rate of $750.00 per calendar day for unexcused delays beyond the date of Substantial Completion.
