TRUSTEE S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 14, 2021, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 602, at Page 34, Gary Lawrence Brown did convey unto John J. Wallace, IV, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on September 13, 2023, at 10:10 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley Bend District, Randolph County, West Virginia, and more particularly described as follows: All that tract or parcel of land situate in Valley Bend District, Randolph County, West Virginia, said land being a part of Lot B-8 of the Tygart Valley Homesteads located in East Dailey, more particularly bound and described as follow: Beginning at a 3/4 inch rebar found in the eastern boundary of Randolph Drive (County Route 21), said point being a corner common to Denver Channell (DB 416/197); thence leaving Randolph Drive with the line of Denver Channell, N 87-02′ E, 163.46 feet to a 5/8 inch rebar found; thence continuing with Denver Channell, S 68-12′ E, 44.75 feet to a brass capped concrete monument found, said point being a corner common to Charles New (DB 477/476); thence with Charles New, S 00-42′ W, 123.05 feet to a 3/4 inch rebar driven; thence thru the parent tract, N 89-13′ W, 199.07 feet to a 3/4 inch by 30 inch rebar driven in the eastern boundary of Randolph Drive on curve to the left with a radius of 736.2 feet for a distance of 128.65 feet to the point of beginning, the chord of said curve being N 01-54′ W, 128.56 feet. Containing 0.612 acres, more or less, as surveyed by William D. Swecker, of Elkins, West Virginia, and as shown on a plat attached to a prior Deed in the chain of title DB 484/271 and, by reference, made a part hereof. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 37 Blackberry Lane, Beverly, WV 26253. AND BEING the same real estate which was conveyed to Gary Lawrence Brown, by Deed dated April 14, 2021, from Vanessa Licwov-Channell f/k/a Vanessa Licwov-Martel and Gerald M. Channell, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 616 at Page 605. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in AS IS condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
