NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 15, 2000, executed by Borrower(s), David J Smearman II and Diana L Smearman, to Progressive Title , the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 917, at Page 417. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 290 Barnstable Dr, Parkersburg, WV 26101. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 21, 2023, of record in the Clerk’s Office in Book 2294, Page 422. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

29th day of September, 2023 at 11:15 a.m.

Situated in the District of Tygart, County of Wood, State of West Virginia and being more particularly bounded and described as follows: Beginning at a point, said point being a common corner of B. Full (Deed Book 859, page 478) and T. Allman (Deed Book 705, Page 394) Thence with the line of said T. Allman Two (2) courses and distances S. 18* 06’00” W. 344.00 feet to a point, passing iron rods (set) at 78.33 feet and 212.40 feet, N. 82* 16′ 00″ W. 94 02 feet to a point in the easterly line of a 40 foot wide right of way. Thence, with the easterly line of said 40′ wide right of way three (3) courses and distances; N. 19* 10′ 51″ W. 175.88 feet to a point, passing a railroad spike (set) at 49.3 feet and passing an iron rod (set) at 149.62 feet, N. 00* 44′ 30″ W. 172.70 feet to a point; N. 18* 48′ 27″ E. 84.37 feet to an iron rod (set) Thence, with the interior of the parent tract N. 6* 20′ 00″ E. 256.27 feet to an iron rod (set) in the westerly line of said B. Full. Thence, with the westerly line of said B. Full S. 00* 30″ 00″ W. 207.23 feet to the point of beginning and containing 2.272 acres more or less Last Deed Reference: Deed Volume 935, Page 947 of the Wood County Recorder’s Office.
Being the same property conveyed to David J Smearman II and Diana L Smearman by the Deed dated October 24, 2000 and recorded in Deed Book 1019 at Page 842 in the Office of the Clerk of the County Commission of Wood County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
