NOTICE OF SALE
UNDER DEED OF TRUST

Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

October 25, 2023
11:00 a.m.

offer for sale certain property described in that certain deed of trust executed by SWEET T’S COUNTRY KITCHEN, LLC to Michael C. Doss, as Trustee, which deed of trust is dated February 10, 2023, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 626, at Page 318; and given to secure Citizens Bank of West Virginia, the payment of a note therein described.

The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction are all that certain lot, parcel or tract of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Valley Bend District, Randolph County, West Virginia, and more particularly bounded and described as follows: all to that certain parcel of real estate fronting on U. S. Route 219 and 250 in Valley Bend District of Randolph County, West Virginia, and more particularly bounded and described as follows:
BEGINNING at a 3/4 inch by 10-inch iron bolt, driven in the southern boundary of U. S. 219-250 on the west side of the road leading into the Bell Trailer Court, said point being N 82* 08′ W. 30.0 feet from a 5/8 inch iron rod found, corner to Wilson Phares; thence leaving U. S. 219-250 along the Trailer Court Road thru the Howard Bell property
S 5* 16′ W. 109.4 feet to a 1 inch by 21-inch iron pipe driven on the west side of the Trailer Court Road; thence leaving the Trailer Court Road thru the Howard Bell property
N 80* 30′ W. 182.6 feet to a 1 inch by 36-inch iron pipe driven; thence continuing thru the Bell Property
N 7* 51′ E. 104.0 feet to a 3/4 inch by 12-inch iron bolt driven in the southern boundary of U. S. 219-250; thence along the southern boundary of U. S. 219-250,
S 82* 08′ E. 177.8 feet to the point of beginning, containing 0.44 acres, more or less, as surveyed by William D. Swecker of Elkins, West Virginia, and depicted on a plat of record and appended to a prior Deed in the chain of title found in Deed Book 289 at page 394, 396.
On the 2022 Land Books of Randolph County, WV, Valley Bend District, Tax Map 1, Parcel 138.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
Together with all buildings, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property, as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property.

And being the same tract or parcel of real estate as acquired by the Grantor by the provisions of a from Moscato & Crown, LLC, said Deed dated February 10, 2023, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 630, at page 829.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
