TRUSTEE S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 7, 2011, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 479, at Page 594, Jesse J. Coberly and Evelyn L. Coberly did convey unto Thomas R. Ross, II, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on October 19, 2023, at 10:14 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley Bend District, Randolph County, West Virginia, and more particularly described as follows: A tract or parcel of real estate situated in Valley Bend District, Randolph County, West Virginia, being a portion of a lot designated as Lot B-9 of the Tygart Valley Homestead, Plat Cabinet A, Slide 19, being more particularly bounded and described as follows: Beginning at a point on the western boundary of Secondary Route 38, Old Trail Road, common corner to Lot B-10; thence N. 89 13′ 00″ W. 298.51′ leaving said Secondary Route 38, Old Trail Road, crossing a small drain or creek, and traveling with a line common to Lot B-10 to a point in a line common to Lot B-7; thence N. 00 47′ 00″ E. 133.74′ traveling with a portion of a line common to Lot B-7 and a portion of a line common to Lot B-8 to a point, common corner to part of Lot B-9; thence S. 89 13′ 08″ E. 118.75′ traveling with a line common to part of Lot B-9 to a point in a line common to part of Lot B-9, Coberly, DB 337/578; thence S. 03 45′ 00″ E. 49.80′ traveling with a line or a portion of a line common to part of Lot B-9, Coberly, DB 337/578, to a point; thence N. 75 28′ 00″ E. 134.18′ traveling with a line common to part of Lot B-9, Coberly, DB 337/578, crossing a small drain or creek, to a point on the western boundary of Secondary Route 38, Old Trail Road; thence S. 20 26′ 00″ E. 128.24′ traveling with the western boundary of said Secondary Route 38, Old Trail Road, to the beginning, containing 0.74 acres, more or less, as inspected by Kenneth Kelly, Professional Surveyor No. 973, of Dailey, WV, in December 1997, and attached to that deed from Betler to Coberly, dated December 2, 1997, of record in the Office of the Clerk of the County Commission of Randolph, West Virginia, in Deed Book 455, at Page 552. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 6715 Back Road, Beverly, WV 26253. AND BEING the same real estate which was conveyed to Jesse J. Coberly and Evelyn L. Coberly, by Deed dated December 2, 1997, from Gene D. Betler, Jr. and JoAnn Betler, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 455, at Page 552. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in AS IS condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
