NOTICE OF
TRUSTEE’S SALE
NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 1283, at page 713 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

WEDNESDAY,
FEBRUARY 7, 2024,
at 9:30 o’clock in the
forenoon, local time,

at public auction, to the highest bidder for cash, all of the right, title and interest of JOSEPH P. ALBRIGHT, JR., a single person, in and to the real property described in a certain deed of trust dated December 30, 1999, to JAMES B. HAYHURST, JR., and STEVEN E. WILSON, original Trustees, for the benefit of United National Bank, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 873, at page 950 thereof, possessed by the said JOSEPH P. ALBRIGHT, JR., as at the making of said deed of trust, which said real estate is described in said deed of trust as being all those certain lots, tracts or parcels of real estate, lying and being situate in the City of Parkersburg, County of Wood, and State of West Virginia, more particulary bounded and described as follows, to-wit:

TRACT ONE: BEGINNING at a stake in the northerly line of a lot formerly owned by J.C. Heaton, said stake being one hundred twenty-six and three tenths (126.3) feet northwest of the intersection of said line with the westerly line of the Jackson Avenue right of way, thence in a northeasterly direction, in a line parallel to the Jackson Avenue right of way, one hundred six and five tenths (106.5) feet, more or less, to a point in the line of the old City Hospital property, thence with the old Hospital line S 56‚ 46′ E fifty-nine and fifty-three hundredths (59.53) feet, more or less, to a stake , corner of lot number twenty-eight (28) of the Camden-Prewitt Addition to the City of Parkersburg, thence in a line known as the old Camden line, being S 43‚ 15′ E, seventy (70) feet to a stake, corner to the Jackson Avenue right of way, thence along the westerly line of the Jackson Avenue right of way S 31‚ 58′ W, eighty-seven (87) feet, more or less, to its intersection with the said J.C. Heaton line, at a nail in the root of a tree, thence with said Heaton Line N 58‚ 06′ W one hundred twenty-six and three tenths (126.3) feet to the place of beginning, the said lot, tract and parcel of land being all the easterly portion, to a depth of one hundred twenty-six and three tenths (126.3) feet, of the land conveyed to the Clare Fey Educational Association by H. S. Johnson and Carrie Johnson, his wife, and by Floyd Sams and Ina Sams, his wife, by deeds dated December 21, 1936, and of record in the office of the Clerk of Wood County Court in Deed Book 215 at pages 361 and 362, respectively.

TRACT TWO: BEGINNING at the Southwesterly corner of Lot No. 28 of the Camden Prewitt Addition to the City of Parkersburg; thence South 29‚ 3′ West 17.92 feet to a point; thence South 58‚ 6′ East 66.77 feet to the Westerly line of Jackson Avenue at a corner and offset thereof; thence along the Southerly line of the aforesaid Lot No. 28, North 43‚ 15′ West 70 feet to the place of beginning. Reference is here had to a plat, of record in Deed Book 495, at page 104 in the said Clerk’s Office.

TRACT THREE: BEGINNING at a point in the easterly line of Lot Number 28 of the S.D. Camden and C. W. Prewitt’s Addition (referred to in prior deeds as S. D. Camden and C. W. Pruewett’s Addition), a plat of which is of record in the Office of the Clerk of the County Court of Wood County, West Virginia, in Plat Book Number 2, at page 8, 40 feet in the southerly direction from where said easterly line intersects the common line between Lots Numbers 28 and 29, thence at right angles in a westerly direction 89.1 feet to a point on the westerly line of said Lot Number 28; thence along the westerly line of Lot Number 28, in a southerly direction 24 feet to its intersection with the southerly line of Lot Number 28; thence in a southeasterly direction along the southerly line of Lot Number 28, 92.88 feet to its intersection with the easterly line of Lot Number 28; thence in an northerly direction 49.84 feet to the place of the beginning, and being part of Lot Number 28 of said Addition. There is excepted a “little” corner of the east of said lot conveyed to the City of Parkersburg for widening the street by F. S. Rardin and Alice E. Rardin, his wife, by deed recorded in the aforesaid Clerk’s Office in Deed Book Number 226, at page 628.

Being the same property conveyed by Joseph P. Albright, Sr., to Joseph P. Albright, Jr., by deed of even date herewith and to be recorded simultaneously herewith.

Upon information and belief, the address of the subject real estate is 1203 Jackson Avenue, Parkersburg, West Virginia 26101.

Upon the following terms to-wit:
1. Cash in hand on day of sale, or as the Trustee may otherwise agree.
2. Minimum acceptable bid is $146,790.00. The sum of $2,500.00 by Bank or Cashier’s check must be delivered at the sale to the Trustee by the successful bidder.
3. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon.
4. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned, and further reserves the right to alter the terms of sale at any such continued sale, including, but not limited to, a lower minimum bid.
5. The undersigned reserves the right to reject any and all bids.
6. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.
7. The premises described hereinabove, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied.
8. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
9. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
10. Sale is subject to the provisions of W.Va. Code §38-1-16 regarding any existing tenancy at the subject premises.
11. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
12. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
13. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
14. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
