NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 15, 2009, executed by the Borrowers, Christopher Bradberry and Michelle L. Bradberry, to CTC Real Estate Services, the Trustee, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Book 458, at Page 611. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3 Old Brady Road, Mabie, WV 26278. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated March 10, 2017, of record in the Clerk’s Office in Book 555, at Page 106. The Borrowers defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property, together with the improvements thereon and the appurtenances thereunto belonging, to the highest bidder at the front door of the Courthouse of Randolph County, in Elkins, West Virginia, on the following date:

March 25, 2024, at 10:12 a.m.

ALL that certain tract of land situate in Roaring Creek District, Randolph County, West Virginia, on the waters of Roaring Creek, more particularly described as follows:

BEGINNING AT A 3/4″ IRON REBAR (SET), BEING A CORNER TO THOMAS GUIRE’S .28 ACRE TRACT (465/598), AND BEING ABOUT 46 FEET NORTHWEST OF THE CENTERLINE OF THE OLD COALTON BRANCH OF THE BALTIMORE AND OHIO RAILROAD (V65:4/4), WHICH IS NOW A 24.8 ACRE TRACT OWNED BY MIKE ROSS, INC. (427/298), FROM WHICH A CAPPED 5/8″ IRON REBAR (FOUND) IS S 25 36 06 E 13.58, THENCE WITH SAID 3.28 ACRE TRACT AND WITH THE NORTHERN RIGHT OF WAY LINE OF SAID RAILROAD AND SAID 24.8 ACRE TRACT S 66 39 45 W 236.73 FEET TO A 3/4″ IRON REBAR (SET), BEING THE NORTHERN RIGHT OF WAY LINE OF SAID RAILROAD AND BEING A CORNER TO SAID 24.8 ACRE TRACT AND BEING ABOUT 35 FEET NORTH OF THE CENTERLINE OF SAID RAILROAD FROM WHICH A TWIN 28″ WHITE OAK TREE (1 PRONG DRY) MADE A WITNESS IS ABOUT S 71-03 W 12.6 FEET, THENCE LEAVING SAID RAILROAD AND SAID 24.8 ACRE TRACT AND ENTERING SAID 3.28 ACRE TRACT WITH TWO (2) LINES OF PARTITION N 13 12 30 W 216.83 FEET TO A 3/4″ IRON REBAR (SET), THENCE N 72 51 27 E 192.10 FEET TO A 3/4″ IRON REBAR (SET), BEING IN THE LINE OF SAID 3.28 ACRE TRACT AND MICHAEL ALESTRA’S 2.09 ACRE TRACT (477/561), FROM WHICH A CAPPED 5/8″ IRON REBAR (FOUND) IS N 25 36 06 W 138.33 FEET. THENCE WITH SAID 3.28 ACRE TRACT AND SAID 2.09 ACRE TRACT. S 25 36 06 E AT ABOUT 64.9 FEET PASSING THROUGH A WOODEN BUILDING OF ALESTRA’S IN ALL 192.87 FEET TO THE BEGINNING CONTAINING 1.00 ACRES MORE OR LESS AS SURVEYED BY ROBERT A. KITZMILLER PS. #635 OF BUCKHANNON, WEST VIRGINIA.

BEING A PART OF THE SAME PROPERTY CONVEYED UNTO THOMAS JOSEPH GUIRE AND DELORES ANN GUIRE, HUSBAND AND WIFE, FROM GRETCHEN CLEAVENGER, FORMERLY GRETCHEN GUIRE, AND DONALD CLEAVENGER, HER HUSBAND; ELIZABETH SHARP, FORMERLY ELIZABETH GUIRE, AND DANNY R SHARP, HER HUSBAND; BARBARA GUIRE, SINGLE; AND STEPHEN GUIRE AND SONDRA GUIRE, HIS WIFE, BY DEED DATED THE 8TH DAY OF MARCH, 1999, AND RECORDED IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF RANDOLPH COUNTY, WEST VIRGINIA, IN DEED BOOK NO. 465, PAGE NO. 598.

Being the same property conveyed to Christopher Bradberry and Michelle L. Bradberry by the Deed dated February 3, 2005 and recorded in Deed Book 501, at Page 278, in the Office of the Clerk of the County Commission of Randolph County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
