The object of the above-entitled action is to obtain damages for Defendants’ default under a Lease Agreement, as is more particularly described in the Complaint filed herein.
It appearing by Affidavit filed in this action that Defendant SANSA LLC, is a Virginia limited liability company; that MOHAMED ELKADY is a resident of Miami, Miami-Date County, Florida, and the Guarantor under the Lease; and KHALLED IHAB HASSAN is a resident of Woodbridge, Prince County, Virginia, and the sole Member of Sansa Apparel LLC; that the Plaintiff unsuccessfully attempted to obtain service of the Summons and Complaint upon the Defendants via Secretary of State, and that the Plaintiff has used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia rules of Civil Procedure, to ascertain the address or whereabouts of Defendants but has not been successful in so doing.
It is therefore ORDERED that SANSA APPAREL, LLC, MOHAMED ELKADY, and KHALLED IHAB HASSAN, appear and serve upon Kayla A. Cook, Bowles Rice LLP, counsel for Plaintiff, whose address is 125 Granville Square, Suite 400, Morgantown, West Virginia, 26501, a response or other defense to the Complaint heretofore filed in this action within 30 days after the date of first publication of this notice. Otherwise, the Court may render a judgment of default against SANSA APPAREL, LLC, MOHAMED ELKADY, and KHALLED IHAB HASSAN, jointly and severally, at any time thereafter, thereby granting the relief requested by Plaintiff in the Complaint.
A copy of said Complaint can be obtained from the Office of the Clerk of the Wood County Circuit Court, Wood County Judicial Building, 2 Government Square, Room 131, Parkersburg, WV 26101-5353.
