TRUSTEE’S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated December 28, 2021, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 2220, at Page 181, Heath M. Patterson did convey unto David G. Palmer, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on
April 16, 2024 , at 4:45 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Williams District, Wood County, West Virginia, and more particularly described as follows:
All that certain lot or parcel of land situate in the District of Williams, County of Wood, State of West Virginia, and being more particularly described as follows:

BEING all of Lot No. 4 of Brierwood Subdivision, Section 2, as shown and described on that certain plat of said sub-division, which is of record in the Office of the County Court of Wood County, West Virginia, in Plat Book No. 15, at page 8, to which plat so of record reference is hereby made and had for a more particular description of said lot.

This conveyance is made subject to the reservations and exceptions contained in prior deeds of record and the building restrictions set forth on the above-mentioned plat.

By the acceptance, purchase and ownership of any lot or lots, the owner or owners automatically becomes or become members and subject to the By-laws, rules and regulations of the Brierwood Subdivision Property Owners Association, its successors and assigns, which organization shall be non-profit and for the purpose of improving and maintaining the public roads and streets, recreational areas, and common lands of said subdivision, each lot of Grantor is sold, Grantor and the remaining unsold lots of Grantor, shall not be subject to this provision unless Grantor so desires and agrees, in writing, to be so subject to the same.

Also, by acceptance of this deed, the grantee, his heirs, and assigns, promise and agree to pay to Wilson Brothers Development and Construction Company, Inc., a West Virginia Corporation, its successors and assigns, the sum of Seven ($7.00) Dollars per month sewage fees until such time as the Public Service Commission of West Virginia shall pay the sewage fees established by said Public Service Commission. This is also a covenant running with the land.

This conveyance is made subject to all easements, rights of way, restriction, reservations, and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations, and leases, appearing in the chain of title.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 92 Warren Avenue, Parkersburg, WV 26104.

AND BEING the same real estate which was conveyed to Heath M. Patterson, by Deed dated November 15, 2021, from Christopher Matthew Frazer and Victoria Lynn Mondin f/k/a Victoria Lynn Frazer, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1333, at Page 791.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale. Pill & Pill, PLLC, Substitute Trustee
