NOTICE TO BIDDERS
Sealed bids will be received by the Cross Creek Township Board of Trustees in their office at 1267 Cadiz Road, Wintersville, Ohio 43953 until 6 P.M. Monday, May 06, 2024 for the 2024 Pavement Repair Project on Township Road 166 (Sheep Rock Road.) Specifications must be secured from the Cross Creek Township Office, 1267 Cadiz Road, Wintersville Oh 43953 with the Deposit of Ten (10.00) Dollars NONE OF WHICH WILL BE REFUNDED. All checks payable to Cross Creek Township. Sealed bids must be submitted in two (2) copies.
Bids for the above-described work must be submitted on the blanks furnished with the bidding
documents. All bids must be accompanied by a BID GUARANTEE in the form of (l) certified check or
Revocable Letter of Credit pursuant to Chapter 1305 ORC, in an amount not less than ten (10%) of the
total of the amount of base bid plus all alternatives: or (2) a Bond drawn upon an acceptable Surety
Company for the full amount of the bid, plus all alternatives, one hundred percent (100%) both ) made
payable to the Cross Creek Township. All bid guaranties shall be conditioned that if the bid is accepted
within sixty (60) days of bid opening, a proper contract shall be executed, and that upon failure or refusal
to enter into said contract with ten (10) days after receipt of notification of award, the bidder and the
surety on any bond shall be liable to the township in the amount not to exceed ten (10%) percent of bid.
The successful bidder upon receipt of the Notice of Acceptance of the bid must furnish a Performance
Bond in the amount of one hundred percent (100%) of the contract amount to the Cross Creek Township Board of Trustees, said bonds to be unconditionally payable to Cross Creek Township Board of
Trustees. Said bonds to be that of an approved Surety Company authorized to transact business in the
State of Ohio and shall be underwritten by a surety that is listed ln the most current Department of
Treasury Circular 570, “Surety Companies Acceptable of Federal Bonds.”
Upon rejection of any bid, the Bid Guaranty shall forthwith be returned to the unsuccessful bidder, upon
the acceptance of a bid the Bid Guaranty shall be returned to the successful bidder upon the proper
execution and securing of the contract.
Each individual employed by the contractor or any subcontractor and engaged in work on the project
under the contract shall be paid the Prevailing Wage Rate established by the State of Ohio. This shall
occur regardless of any contractual relationships, which may be said to exist between the contractor or
any Subcontractor and such individual. No bidder may withdraw his/her bid during a period of sixty (60) days after the date of the opening.
The Non Collusion Affidavit by Prime Bidders must be completed and submitted with all proposals.
All bids must be made identified by marking sealed envelope – BID 2024 ROAD REPAIR PROJECT
TOWNSHIP ROAD 166 (Sheep Rock Road).
If at the determination of the Cross Creek Township Board of Trustees, the acceptance of the lowest bid
is not in the best interest of all concerned, said Board of Trustees may accept another bid so opened.
The Cross Creek Township Board of Trustees reserve the right to accept or reject any and all bids, and
to waive all informalities and without any disclosure of a reason. The failure to make such a disclosure
shall not result in accrual of any right, claim or cause of action by an unsuccessful bidder against the
Cross Creek Township Trustees.
