The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 10, 2021, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 2165, at Page 26, Danny Ray Simmons and Rose Mary Simmons did convey unto Robert L. Shuman, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the 26 District, Wood County, West Virginia, and more particularly described as follows:
All that certain lot, tract or parcel of land situate and being in Union District, Wood County, West Virginia, and more particularly bounded and described as follows:
Beginning at an iron pipe at the northeasterly intersection of the right-of-way boundaries of State Route 68 (formerly Rt. 2) and Ashby Ridge Road also known as West Virginia Secondary 2/13; thence with the easterly right-of-way line of State Route 68 North 73 degrees 54 minutes East 204.29 feet to a point; thence South 49 degrees 55 minutes East 198.27 feet to an iron pipe at the northerly boundary of Ashby Ridge Road; thence with the northerly boundary of Ashby Ridge Road; thence with the northerly boundary of Ashby Ridge Road four calls, North 81 degrees 17 minutes West 62.96 feet to a point, North 87 degrees 53 minutes West 81.56 feet to a point, North 73 degrees 02 minutes West 111.50 feet to a point, North 75 degrees 08 minutes West 100.98 feet to the beginning, containing 0.441 acres, more or less.
This being the same property conveyed to Danny Ray Simmons and Rose Mary Simmons, husband and wife, jointly, for and during the term of their joint lives and upon the death of either of them to the survivor, dated 03/19/2004 and recorded on 3/19/2004 in Instrument No. 435203, in the Wood County recorders office.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 63 Old Ashby Ridge Road, Parkersburg, WV 26104.
AND BEING the same real estate which was conveyed to Danny Ray Simmons and Rose Mary Simmons, by Deed dated November 6, 1995, from Rodney G. Oyler , Sandra L. Schmidt and Barbara J. Oyler, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 950, at Page 67.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
