The purpose of the above action is to determine guardianship of the children, G.L.K., born on September 12, 2019 and G.A.K., born on November 19, 2021, to Arizona Arawanna Nicholson. The petitioner, the West Virginia Department of Health Services, is seeking permanent legal and physical custody of the said infant child.
It is ORDERED that the Respondent Biological Father, Timothy Lee Kirby, of the aforementioned children, appear in the Doddridge County Circuit Court, 2nd Floor, Doddridge County Courthouse, West Union, West Virginia, on the 29th day of October, 2024 at 9:30 o’clock a.m., or as soon thereafter as it may be heard, for a Preliminary/
Adjudicatory/Status Hearing. Parties should note that these matters get continued on occasion for good cause and should contact their Counsel as soon as possible. Said persons are instructed that they have 10 (ten) days from this Notice to answer the Petition herein. Said persons are given notice that they must object, or, otherwise permanent legal and physical custody of the said infant children may be granted to the West Virginia Department of Health and Human Resources and parental rights may be permanently terminated.
