Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated January 23, 2025, and of record in the Office of the Clerk of the Hancock County Commission in Official Record Book 905, at page 305, will sell at public auction to the highest bidder on:
March 18, 2025, at 11:00 a.m.,
at the front door of the Hancock County Courthouse, 102 N. Court Street, New Cumberland, West Virginia, that certain property conveyed by Tory Fluharty (n/k/a Tory Roupe), to Rona! W. Rush, original Trustee, recorded in Hanock County Official Record Book 893, at page 1526, and being described as follows:
All that certain lot or parcel of land situate in the District of Butler, County of Hancock, and State of West Virginia, and known as and being Lot Number Fourteen (14) in Block “D” of Weirmont Terrace plan of lots, which said plan is ofrecord in the Office of the Clerk of the County Court of Hancock County, West Virginia, in Plat Book Number 2, Page 2. Said deed is subject to general plat restrictions and reservations as shown in former deeds.
Being the same property conveyed to To1y Fluharty (n/k/a To1y Roupe) by Norma Lee Mcie, Goff Cole, Mary Louise McAbee, Karen Jewell Vespaziani and Ronald Vespaziani, her husband, by Deed dated May 21, 2013, and recorded in Hanock County Official Record Book 823, at page 1801.
Tax District: 6; Tax Map: W43A; Parcel: 84 Property Address: 105 Pikeview Road, Weirton, West Virginia.
The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (I) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-
6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
