IN THE MATTER OF: CIVIL ACTION NO. 25-C-30, COMPLAINT FOR DECLARATORY JUDGMENT AND TO QUIET TITLE. Pursuant to Rule 4 of the West Virginia Rules of Civil Procedure and Chapter 56 of the West Virginia Code, the Plaintiffs, Madeline Butcher and Kenneth Butcher, provide this is notice to The Heirs and Beneficiaries of John Lipasek, deceased, and Any John Doe or Jane Doe Claiming Title or Interest, Defendants, and to any other parties required notice by law or to any other party that may claim to be entitled to notice, that on Friday, the 25th day of April, 2025 at 9:00 a.m., a hearing will be held on the Petitioners’ Complaint for Declaratory Judgment and to Quiet Title before the Honorable David J. Sims, Circuit Judge of Hancock County, West Virginia. Said hearing shall be held by Microsoft TEAMS. The credentials to log and participate in the TEAMS hearing can be obtained by contacting the Hancock County Circuit Clerk’s Office as the same are lodged in the Court’s file. The object of this Complaint and civil action is to terminate any claims or rights the known or unknown Defendants may have to the real estate subject to this Complaint, including any mineral rights, if applicable. Said real estate is identified by the County Assessor for Hancock County, WV as being in the District of Grant, County of Hancock, and State of West Virginia, having a map number of G2S, parcel number 0115 0000 0000, and a legal description of 1488 N A MFG CO GRANT ST. Failure to respond to this notice and/or failure to appear and defend his /her rights, if any, within 30 days of the first date of publication of this notice may result in the termination of any right to assert a claim or contest this Complaint and the relief requested by the Plaintiffs. If you or any other interested party fails to respond to this notice within said 30 days, then said person may not appear in or receive further notice of these proceedings. A copy of said Petition may be obtained at the Hancock County Circuit Court Clerk’s Office and an Answer may be filed with the same office, PO Box 428, 102 N. Court Street, New Cumberland, West Virginia, 26047 and with counsel for the Petitioners, April Manypenny Raines, Esq., 300 Carolina Avenue, Chester, WV 26034. After due consideration of this matter, it is ORDERED, ADJUDGED AND DECREED, that this notice be duly published as a Class II advertisement in a local newspaper of general circulation in accordance with the law.
