NOTICE OF BONDED SPECIAL COMMISSIONER’S SALE NOTICE OF SPECIAL COMMISSIONER’S SALE is hereby given pursuant to and by virtue of the authority vested in the Bonded Special Commissioner, WV Trustee Services, LLC, by Order of the Circuit Court of Roane County, West Virginia entered on May 30, 2025, Civil Action No. CC-44-2024-P-38 in regard to that certain Deed of Trust dated April 11, 2007, executed by Borrower(s), Linda C Nash and Richard E Nash, to Phil Litteral, the Trustee of record in the office of the Clerk of the County Commission of Roane County, West Virginia, in Book 275, at Page 643. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 973 Clover Rd, Spencer, WV 25276. The borrower(s) defaulted under the Note and Deed of Trust and the Bonded Special Commissioner has been instructed to foreclose under the Deed of Trust. Accordingly, the Bonded Special Commissioner will sell the following described property to the highest bidder at the front door of the Courthouse of Roane County, in Spencer, West Virginia, on the following date: 3rd day of October, 2025 at 11:00 a.m. All of that certain lot, tract, or parcel of land situate, lying, and being on the waters of Rush Creek of Henry`s Fork in Smithfield District, Roane County, West Virginia, and more particularly bounded and described as follows: BEGINNING at a stake in the road, and running thence with said road S. 78 E. 15 poles and 14 links to a stake; thence S. 48 1/2 E. 11 poles and 18 links to a stake; thence leaving the road S. 34 W. 20 2/5 poles to a Black Walnut; thence E. 7 poles and 10 links to a Wild Cherry; thence S. 56 1/2 E. 18 poles to a Sugar; thence N. 43 E. 32 poles to a stake; thence N. 48 W. 18 poles to a sugar; thence N. 49 1/2 E. 19 poles to a Sassafras; thence N. 1/2 E. 56 poles to a stake; thence N. 61 W. 34 1/2 poles to an ash; thence N. 43 W. 49 poles to a Dogwood; thence N, 49 1/2 W. 22 poles to a stake with ash pointers; thence S. 43 W. 26 poles to a stake in the road; thence with said road S. 39 1/2 E. 26 poles to a stake; thence S. 19 E. 12 poles to a stake; thence S. 44 E. 10 poles to a stake; thence S. 74E. 13 poles to the place of beginning, containing 37 1/2 acres, more or less. There is excepted and reserved from the above described tract or parcel of land for the benefit of the first party hereto all of that certain portion thereof which is situate and lies south of West Virginia county numbered route 36/5 and the center line of said county numbered route is to be the division line between the tract conveyed hereby and the reserved portion, which reserved portion is believed to be 7 1/2 acres, more or less, leaving a tract of approximately 30 acres, more or less, conveyed hereby. There is further excepted and reserved from said 37 1/2 acres a parcel of 9,636 square feet, more or less, granted and conveyed by Noble Moore and wife to William H. Boggs, by deed of date 4 May 1948 of record in the Office of the Clerk of the County Court, of said Roane County in Deed Book No. 196, at page 27, wherein said excepted parcel is bounded and described as follows: Beginning at a stake, thence S. 62-55 E. 118 feet to a post; thence S. 0-55 E. 188 feet to a stake; thence N. 23 W. 264 feet to the place of beginning. BEING a part of the tract described as the FIRST TRACT in that certain deed from Anna Lehtomaki, a Widow, to J. L. Nichols and America Nichols, as joint tenants with rights of survivorship, by deed bearing date 14 April 1970 which is of record in the Office of the Clerk of the County Commission of said Roane County, West Virginia, in Deed Book No. 231 at page 581; L. L. Nichols died 25 February 1978. This conveyance is made subject to any easements and rights of way over, through, and across said real estate and is further made subject to any and all outstanding interests in and to the oil gas and other minerals within and underlying the same. BEING all and the same lot of ground which by Deed dated March 28, 1978, and recorded among the Land Records of Roane County, West Virginia in Liber 266, folio 16, was granted and conveyed by America Nichols, a widow unto Richard E. Nash and Linda C. Nash, Surviving Joint Tenants of Dorothy McKenzie. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONDED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY 5) The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Special Commissioner within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Special Commissioner at sale.
