NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 12, 2021, executed by Borrower(s), Junior Gene Boggs and Brenda L Wright, to Drew Patton, the Trustee of record in the office of the Clerk of the County Commission of Roane County, West Virginia, in Book 362, at Page 8. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 573 ARNOLDSBURG ROAD, Spencer , WV 25276. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 4, 2025, of record in the Clerk’s Office in Book 385, Page 591. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Roane County, in Spencer, West Virginia, on the following date: 22nd day of October, 2025 at 11:00 a.m. All of that certain lot, tract or parcel of land situate on the waters of Goffs Run, in Spencer District, Roane County, West Virginia, and more particularly bounded and described as follows: BEGINNING at a concrete monument found 30 feet north of the center line of U.S. 33 and 119, a corner to Amold Parker, thence with a line parallel to U.S. 33 and leaving U.S. 33 and 119 and with the Hazeline Anderson tract N. 11-20 W. 200.85 feet to an iron pin set in the southerly right-of-way line of old U.S. 33; thence with said right-of-way N. 64-56 E. 138.04 feet to a point in the southerly right-of-way line of old U.S. Route 33, a corner to Arnold R. Parker, said point being N. 26-48 E. 172.51 feet to an iron pipe set; thence S. 27-47 W. 8.24 feet to an iron pipe set thence S. 72-20 W. 58.00 feet to an iron pipe set; thence S. 0-50 W. 80.00 feet to the place of beginning, containing 0.75 acres, more or less. There is expressly reserved from the above tract of land any right-of-way the State may have greater than 30 feet from the centerline of U.S. Route 33 and 119. There is further expressly excepted and reserved from this conveyance a right-of-way for an existing gas line and equipment and the installation and maintenance of same, over, through and across the above-described parcel of real estate tor the benefit of Hazeline Anderson, her heirs and assigns. This deed is made in satisfaction of that certain Land Contract dated February 11, 2011, between the parties hereto, of record in the said Clerk`s Office in Deed Book 472, at page 441. BEING the same real estate conveyed unto David Ray Rogers Jr. and Layla J. Rogers, husband and wife, by Jarret L. Justice by Deed dated July 3, 2020, and of record in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Deed Book 612, at page 662 This conveyance is made and accepted subject to all outstanding interests in and to the oil, gas and other minerals within and underlying said tract of land, and is further made subject to any easements or rights of way over, through and across said real estate. FURTHER BEING the same real estate conveyed unto Junior Gene Boggs and Brenda L. Wright by David Ray Rogers Jr. and Layla J. Rogers, husband and wife, by Deed dated March 22, 2021, recorded in Book 619, Pg 489. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
