NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: October 3, 2025 City of Spencer 116 Court Street Spencer, WV 25276 304-927-1640 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Spencer. REQUEST FOR RELEASE OF FUNDS On or after October 18, 2025 the City of Spencer will submit a request to the West Virginia Department of Economic Development for the release of Community Development Block Grant funds under Title 1 of the Housing and Community Development Act of 1974, to undertake the following project: Project Title: Schoolhouse Hill Water Line Replacement 21CDBG0006 2020W-1912 Purpose: The purpose of this project is to replace failing water lines. This area includes some of the oldest main lines in the system – much of it is old cast iron line that has been in use for over 65 years. Location: Spencer, Roane County, WV Estimated Cost: CDBG $1,150,000 out of a total cost of $1,200,000 FINDING OF NO SIGNIFICANT IMPACT The City of Spencer has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Spencer City Building and at MOVRC, 709 Market Street, Parkersburg, WV 26101 and may be examined or copied weekdays 9:00 A.M to 3:00 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Spencer 116 Court Street Spencer, WV 25267. All comments received by October 17, 2025 will be considered by the City of Spencer prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The City of Spencer certifies to The State of West Virginia that Terry Williams in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The State of West Virginia’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Spencer to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS The State of West Virginia will accept objections to its release of funds and the City of Spencer’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Spencer; (b) the City of Spencer has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by State of West Virginia; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to West Virginia Department of Economic Development, CAD at 1900 Kanawha Blvd. East, Bldg. 3, Suite 700, Charleston, WV 25305.
