NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE

Pursuant to the authority vested in the undersigned by deed of trust dated the 31st day of January 2007, signed by Michael I. Bell and Lola M. Bell, husband and wife, to David E. Thompson, Trustee(s), which said deed of trust is of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 31, at page 427, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 1:00 o’clock P.M. on the

25th day of NOVEMBER 2019

at the front doors of the Courthouse in Randolph County in Elkins, West Virginia the following described real estate:

All that certain tract or parcel of real estate situate in Leadsville District of Randolph County, West Virginia, located on the waters of Cross Run, and on the south side of State Secondary Route 25/1, and more particularly bounded and described as follows:

BEGINNING at a 30″ long, 1″ diameter iron pipe set in the centerline of a ravine in the common line between Myles Lumber Company and Vilas Dale Stalnaker from which pipe a 14″ gum with pointers is North 62048 east 11.28 feet, a 10″ birch with pointers is north 20-24 east 11.42 feet, and an 8″ hickory with pointers is south 74-00 west 4.95 feet; thence with the centerline of said ravine, north 42-28 west 95.39 feet to a 30″ long, 1″ diameter iron pipe set in center line of said ravine, from which pipe is 12″ maple with pointers is north 48-030 east 9.0 feet, a 10″ ironwood with pointers is north 25-30 west 11.1 feet and a 24″ forked maple with pointers is south 20-12 west 12.85 feet; thence with centerline of said ravine, north 18-35 west 74.08 feet to a 30″ long, 1″ diameter iron pipe set in centerline of said ravine, from which pipe twin 4″ hickories with pointers are north 52-06 east 8.6 feet, 7″ dogwood with pointers is north 1-06 east 10.7 feet, and a 6″ maple with pointers is north 59-00 west 17.45 feet; thence with centerline of said ravine, north 43-06 west 117.71 feet to a 30″ long, 1″ diameter iron pipe set in centerline of said ravine, from which pipe a 3″ dogwood with pointers is north 66-12 east 4.85 feet, a 4″ hickory with pointers is north 38-20 west 16.25 feet, and an 8″ ash with pointers is south 85-12 west 10.0 feet; thence with centerline of said ravine, north 50-25 west 83.02 to a 30″ long, 1″ diameter iron pipe set in centerline of said ravine from which pipe as 8″ locust with pointers is north 77-48 east 16.55 feet, an 8″ poplar with pointers is south 31-00 west 11.45 feet; thence with centerline of said ravine, north 32-31 west at 98.21 feet in centerline of State Secondary Road 25/1, in all 141.92 feet to a 30″ long, 1″ diameter iron pipe set in centerline of said ravine and in the common line of Paul and Betty Cook and Vilas Dale Stalnaker, from which pipe a 6″ poplar with pointers is south 41-48 east of 6.55 feet, twin 18″ culverts are south 38-30 east 29.75 feet, twin 4″ maples with pointers are south 5-30 east 7.55 feet, and a 5″ maple with pointers is south 58-06 west 12.25 feet; thence with reverse of Paul and Betty Cook’s line, north 58-06 east of 23.23 feet found an iron pipe which is the common corner of Paul and Betty Cook, Cecil and Rosetta Pingley and Vilas Dale Stalnaker, from which pipe a 24″ white oak with pointers is south 19-00 east 18.4 feet; thence with Cecil and Rosetta Pingley’s line reversed, in all 70.38 feet to a 1″ diameter iron pipe previously set, from which pipe a 20″ maple with pointers is south 50-00 west 10.25 feet, and a 20″ maple with pointers north 57-30 east 14.25 feet; thence north 78-14 east 52-90 feet to a 3″ nail set in State Secondary Road 25/1 from which nail is 20″ maple with pointers is south 86-18 west 40 feet; a 24″ white oak with pointers is south 74-06 west 62.0 feet, and a 24″ long, 1″ reinforcement steel rod is south 11-49 east 15.0 feet from which rod a 20″ maple with pointers is north 74-48 west 44.55 feet, and a 24″ maple with pointers is south 87-00 west 63.0 feet; thence with said road, north 78-11 east 100.00 feet to a 3″ forked maple with pointers is north 66-54 east 6.4 feet, a 4″ maple with pointers is north 24-30 east 17.5 feet, and a 30″ long, 1″ diameter reinforcement steel rod is south 0-42 east 15-0 feet, from which a rod a 3″ forked maple with pointers is south 7-00 west 26.72 feet and a 4″ maple with pointers is south 35-12 west 20-95 feet; thence with said road, north 89018 east 100.0 feet to a 3″ nail set in said road, from which nail an electric pole is north 43-30 west 75.10 feet, an 8″ maple with pointers is south 19-30 east 14.20 feet, and a 30″ long, 1″ diameter iron pipe is south 4-07 east 15.0 feet, from which pipe an 8″ poplar with pointers is south 4-07 east 59.5 feet, a 9″ maple with pointers is north 66-00 east 4.5 feet; thence south 4-07 east 466.50 feet to a 30″ long, 1″ diameter iron pipe set in the common line of Vilas Dale Stalnaker and Myles Lumber Company, from which pipe a 6″ white oak is north 2-12 east 13.25 feet, an 8″ maple is north 65-36 east 13.54 feet, and a 6″ beech is north 80-48 west 9.60 feet; thence with reverse of Myles Lumber Company’s line, south 85-08 west 34/80 feet to the point of beginning, containing 1.96 acres, more or less, as surveyed by George D. Updike in August, 1972

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights of way and easements as set forth in prior instruments of record in the chain of title to said real estate.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third-party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
