TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 16, 2020, and duly recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Document No. 250990, in Book No. 706, at Page 131, Anthony G Sigmon did convey unto Adams, Fisher & Chappell, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by loanDepot.com, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Jackson County Courthouse in Ripley, West Virginia, on February 23, 2026 at 1:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 – Ripley District District, Jackson County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of real estate situate, lying and being on the Waters of Grass Lick, Ripley District, Jackson County, West Virginia, more particularly bounded and described as follows: BEGINNING at a rebar found this survey, said rebar being a corner to the lands of Joseph Prater, James Batton and at the edge of a 40 foot wide road right of way, commonly known as Cedar Valley Road; thence with said Prater and said Batton S. 17 deg. 05′ E. 120.00 feet to a rebar set for this survey, said rebar being a corner to Parcel A and Parcel B of this survey and in a line of the lands of said Batton; thence with the division line of said Parcels A and B S. 68 deg. 30′ W. 194.64 feet to a rebar set for this survey, said rebar being a corner to said Parcels A and B and at the edge of an unnamed 40 foot wide road right of way; thence with said Prater and said right of way the following two (2) courses and distances: (1) N. 15 deg. 08′ 30″ W. 30 feet to a rebar found; thence (2) N. 20 deg. 24′ 30″ W. 96.33 feet to a point, said point being at the intersection of said unnamed right of way and Cedar Valley Road; thence with said right of way, commonly known as Cedar Valley Road N. 70 deg. 19′ E. 184.58 feet to the place of beginning, containing 0.5 acres, more or less. The real estate herein described is the same real estate as conveyed unto Harry M. Murphy and Cathy A. Murphy, his wife, as joint tenants with the right of survivorship and not as tenants in common, by Harry M. Murphy by deed dated July 24, 2013, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 432, page 466. Thereafter, Harry M. Murphy died and by operation of law the above described real estate vested in Cathy A. Murphy. Thereafter, Cathy Ann Murphy died testate a residence of Jackson County, West Virginia and by the terms of her Last Will and Testament dated April 15, 2015, of record in the aforesaid Clerk’s Office in Will Book 59, page 989, devised the above described real estate unto her children, to-wit: Charmin Rae McCarty and Terry Gale Cunningham, Jr. Thereafter, by deed dated May 1, 2017, of record in the aforesaid Clerk’s Office in Deed Book 480, page 887, Charmin Rae McCarty and Terry Gale Cunningham, Jr., sister and brother, conveyed the above described real estate unto Gary A. Lineberry and Bonnie A. Lineberry, husband and wife. Thereafter, by deed dated November 17, 2020, not yet of record in the aforesaid Clerk’s Office, but to be recorded simultaneously herewith, Gary A. Lineberry and Bonnie A. Lineberry, husband and wife, conveyed the above described real estate unto Anthony G. Sigmon. This conveyance is made subject to all oil, gas and other mineral reservations as made by predecessors in the chain of title and to all valid and existing rights of way and easements and any all restrictive and protective covenants appearing of record. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 412 Cedar Valley Road, Ripley, WV 25271. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
