NOTICE OF TRUSTEE’S SALE

Under authority of that certain Deed of Trust dated October 16, 2013, from Joshua James Pingley and Alisha Kristine McLaughlin to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Randolph County, West Virginia in Trust Deed Book No. 516, at page 594, securing a promissory note in the principal amount of $74,414.75, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Randolph County Courthouse in Elkins, West Virginia, on February 7, 2020 at 9:00 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain tract or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate on West Virginia Secondary Route 37/8, 0.9 mile southeast of the intersection of WV Secondary Route 37 (Back Road), and 5 miles south of Dailey, on the waters of Crawford Run of the Tygart Valley River, Valley Bend District, Randolph County, West Virginia, being more particularly bounded and described as follows:

Beginning at Corner No. 1, a point in a fence line, 10 feet west of the centerline of an existing farm access road and opposite a gate, a corner to Victor L. Pingley reserved land (Part of Deed Book 506 at page 320- Tract #3), set a 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence through the said parent Pingley tract and with eight lines, 10 feet north of and parallel to, the centerline of said existing farm access road, now a designated 20 feet wide road right-of-way for ingress and egress to this described parcel and with the arc of a 130* 49′ curve to the right having a radius of 43.80 feet and a central angle of 84* 35′ for a length of 64.66 feet CHORD = S 28* 52′ W, 58.94 Feet to a point, thence S 71* 11′ W, at 13 feet crossing Crawford Run, in All 46.42 Feet to a point, thence S 84* 00′ W, 30.45 Feet to a point, thence S 89* 53′ W, 115.90 Feet to a point, thence N 84* 02′ W, 31.87 Feet to a point, thence N 72* 26′ W, 74.14 Feet to Corner No. 2, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence N 64* 05′ W, 150.73 Feet to Corner No. 3, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence N 74* 24′ W, at 132 feet crossing the end of said designated road right-of-way, In All 137.26 Feet to Corner No. 4, a point 1.3 feet northwest of an existing wire fence, a corner to said Victor L. Pingley reserved land and a corner in line of Tanners Farm LLC (Deed Book 508 at page 765) set a 3/4 inch by 42 inch rebar with a 2-3/4 inch diameter orange plastic cap, from which an electric power pole #A1893 bears S 86* 50′ E, 4.60 feet and a car axle found with a down marked stone, at a wire fence corner, a corner to said Tanners Farm and Pingley, bears S 60* 13′ W, 1595.07 feet, thence with said Tanners Farm LLC and in part along a wire fence N 60* 14′ E, 397.09 Feet to Corner No. 5, a point in the west edge of the creek bed of Crawford Run, a corner in line of said Tanners Farm LLC and a corner to said Pingley reserved land, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, from which a 2 inch diameter iron pipe with brass cap, found, USA Corner No. 2-436, bears N 60* 13′ E, 145.84 feet, thence through the parent Pingley tract of Deed Book 506 at page 320 S 43* 40′ E, 353.42 Feet to Corner No. 1, the Beginning, Containing 2.33 Acres, as surveyed in July 2012 by Leon G. Mallow, Professional Surveyor of Leon G. Mallow Surveying, Inc., Route 1, Box 117, Montrose, WV and as shown on a plat attached and made a part of this description.

Inclusive of a 20 feet wide road right-of-way, the centerline being along an existing arm access road, for ingress and egress to the above-described parcel and the western boundary of said right-of-way being described as follows: Beginning at Point “A”, being in Tanners Farm LLC line and 10 feet southwest of the centerline of said farm road, from which Corner No. 5 bears S 60* 13′ W, 83.60 feet, USA Corner No. 2-436 bears N 60* 13′ E, 62.24 feet, a 16 inch hemlock bears N 50* 00′ W, 8.0 feet and a 16 inch chestnut oak bears S 9* 50′ W, 11.0 feet thence with seven lines west of and parallel to the centerline said existing farm road S 18* 08′ E, 64.58 Feet to a point, thence with the arc of a 44* 04′ curve to the left, having a radius of 130.00 feet and a central angle of 22* 44′ for a length of 51.57 feet CHORD = S 29* 45′ E, 51.24 Feet to a point, thence S 40* 27′ E, 37.06 Feet to a point, thence with the arc of a 30* 29′ curve to the right, having a radius of 188.00 feet and a central angle of 10* 24′ for a length of 34.10 feet CHORD = S 35* 36′ E, 34.05 Feet to a point, thence S 30* 24′ E, 60.82 Feet to a point, thence S 33* 17′ E, 82.63 Feet to a point, thence with the arc of a 130* 49′ curve to the right having a radius of 43.80 and a central angle of 19* 52′ for a length of 15.19 feet CHORD = S 23* 18′ E, 15.11 Feet to Corner No. 1, a set 3/4 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence continuing with eight lines north of and parallel to the centerline said existing farm road and common with the southern boundary of the 2.33 acre surveyed parcel and continuing with the arc of said 130* 49′ curve to the right having a radius of 43.80 feet for a length of 64.66 feet CHORD = S 28* 52′ W, 58.94 Feet to a point, thence S 71* 11′ W, at 13 feet crossing Crawford Run, In All 46.42 Feet to a point, thence S 84* 00′ W, 30.45 Feet to a point, thence S 89* 53′ W, 115.90 Feet to a point, thence N 84* 02′ W, 31.87 Feet to a point, thence N 72* 26′ W, 74.14 Feet to Corner No. 2, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence N 64* 05′ W, 150.73 Feet to Corner No. 3, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence N 74* 24′ W, 132.00 Feet to the end of said designated road right-of-way, opposite an electric power pole, from which Corner No. 4 bears N 74* 24′ W, 5.26 feet.

Being part of Tract Three, a parent 36.71 acre tract of land as was conveyed by Victor . Pingley and Randall L. Pingley to VICTOR L. PINGLEY AND SONDRA J. PINGLEY on October 10, 2005 and recorded in the Office of the County Clerk of Randolph County in Deed Book 506 at page 230. A survey pat of this 36.71 acre tract is of record in Deed Book 320 at page 391. Tax Map Sheet 121, Part of Parcel No. 31.

Being the same property conveyed from Victor L. Pingley and Sondra J. Pingley, husband and wife, to Joshua J. Pingley by Deed dated August 22, 2012, of record in the aforesaid Clerk’s office in Deed Book No. 554, at page 526.
Terms of the sale: Terms of the sale: Ten percent nonrefundable cash deposit due at time of sale. Balance of purchase price due within thirty days of sale.
