ORDER OF PUBLICATION
The object of the above entitled Action is to quiet title in Plaintiff as to all of that certain tract of land situate in Middle Fork District of Randolph County, West Virginia, on the head waters of the Main Right Hand of the Buckhannon River, bounded and described as follows:
Beginning at a beech, the Northwest corner of a tract of 473 acres of land conveyed by John T. McKissic to James Pickens; thence North 216 poles to a Sugar; thence East 200 poles to a stake; thence South 227 poles to a stake, the Northeast corner of the said land for which the said John T. McKissic made a deed to the said James Pickens; and thence therewith North 85 W. 208 poles to the beginning, containing in the boundary of 277 acres, more or less.
Being the same tract or parcel of real estate conveyed by Mary Pickens, to Lou V. Dent, et al., by deed dated January 12, 1917, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book No. 107, at page 147.
EXCEPTING AND RESERVING and ABATING there from, and not hereby conveyed, a tract of twenty-six (26) acres thereof conveyed by Elmore H. Pickens to James Pickens, by deed dated the 25th day of September, 1904, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book No. 75, at page 267; and FURTHER EXCEPTING, RESERVING and ABATING therefrom, and not hereby conveyed, a certain parcel of thirty and a fraction acres conveyed by James Pickens to Albert R. Hicks, by deed of record in the aforesaid Clerk’s Office.
The foregoing tract was conveyed to Ralph H. Harper by Marmaduke H. Dent as Attorney in Fact for Mary P. Spratt, T.M. Spratt, Chase E. Hudak, Beth Hudak, Anna Lou Orndorph and others by deed dated July 16, 1986 recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia in Deed Book 378 at page 462.
It appearing by Affidavit in this Action that some of the Defendants and their unknown heirs, successors and assigns are non-residents of the State of West Virginia, that there are or may be persons other than those named above as Defendants who are heirs, successors or assigns of the said named Defendants who may be interested in said lands, whose names are unknown tot the Plaintiffs, and who are made parties to the Complaint filed in this action by the general description of unknown defendant; it is;
Ordered that each of them do appear and serve upon Terry D. Reed, the Law Firm of Hymes and Coonts, P.O. Box 310, Buckhannon, West Virginia, 26201, who is Plaintiffs attorney, an answer or other defense to the Complaint filed in this action on or before the 10th day of February, 2020, otherwise judgment by default may be taken against them at any time thereafter.
A copy of said Complaint can be obtained from the undersigned Clerk at his office located in the Randolph County Courthouse, Elkins, West Virginia.
