Early Notice and Public Review of a Proposed Activity in a 100-Year Floodplain To: All interested Agencies, Groups and Individuals This is to give notice that that the City of Spencer has determined that the following proposed action under the Community Development Block Grant – MIT NGIPLMI-0010 is located in the 100-year floodplain, and the City of Spencer will be identifying and evaluating practicable alternatives to locating the action in the floodplain and the potential impacts on the floodplain from the proposed action, as required by Executive Order 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. This project proposes to undertake sanitary sewer system improvements using Community Development Block Grant- Mitigation (CDBG-MIT) funds to reduce flood-related damage, inflow and infiltration, and sanitary sewer overflows associated with existing infrastructure located near Spring Creek and its tributaries. This includes relocation and replacement of approximately 2,100 linear feet of sewer line, rehabilitation of approximately 72 manholes, construction of lift station and grinder station facilities, and construction of additional surge storage at the existing wastewater treatment plant. Portions of the project are located within the 100-year floodplain; however, the activity is designed to remove or protect vulnerable infrastructure from flood-prone areas. Short-term construction impacts may include temporary disturbance of floodplain soils and riparian areas, while long-term benefits include improved water quality, reduced risk of sewer overflows, and enhanced protection of natural floodplain functions. The proposed project(s) work areas include Front Street, the Elm Street sewer crossing of Spring Creek, and locations along the U.S. Route 119 Bypass, all within existing utility corridors and previously disturbed areas in The City of Spencer, WV, Roane County. There are three primary purposes for this notice. First, people who may be affected by activities in floodplains/wetlands and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplains/wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplains/wetlands, it must inform those who may be put at greater or continued risk.
