TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 18, 2022, and duly recorded in the Office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed of Trust Book 631, at Page 494, Shenandoah W. Snyder and Karrie L. Snyder did convey unto Tara M. Yutzy Collier, LLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mineral County Courthouse, in Keyser, West Virginia, on April 22, 2026, at 9:00 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Elk District, Mineral County, West Virginia, and more particularly described as follows: Property 1: ALL that lot or parcel of land located on the west side of Sulphur-Nethken Road, about 50′ east of State Route 42, in the community of Sulphur City, lying in Elk District of Mineral County, West Virginia, and more particularly described as follows: BEGINNING at a 5/8″ capped rebar found, (McDowell), in the forks of two driveways, being a corner between a 0.506 acre lot owned by William L. Mayhew, Jr., (Deed Book 297, Page 672) and the 1.74 acre lot of which this is a part, thence running with two lines between Mayhew and the 1.74 acre lot N. 13 deg. 39′ 08″ E 100.50′ to a 5/8″ capped rebar found, )McDowell), thence N. 82 deg. 27′ 32″ E. 104.05′ to a 5/8″ capped rebar found, (McDowell), on the west side of the Sulphur-Nethken Road, being a corner between Mayhew and the 1.74 acre lot, thence leaving Mayhew and running with the west side of the road S. 00 deg. 58′ 08″ E. 82.15′ to a 5/8″ rebar set 15′ west of the center of the road, thence leaving the road and running with a new division line through the 1.74 acre lot S 77 deg. 11’10” W. 131.53′ to the BEGINNING containing 0.23 acre, more or less, as surveyed in September, 2010 by Dick A. Heavner and as shown on a plat recorded in the Office of the Clerk of the County Commission for Mineral County, West Virginia, in Deed Book 345, Page 592. SUBJECT to the merger of this property with the adjoining 0.506 acre parcel which is ore fully described in that deed recorded in the Office of the Clerk of the County Commission for Mineral County, West Virginia, in Deed Book 297, Page 672, for the exclusive purpose of increasing the area of said parcel; the merged properties shall not be used or sold individually unless the prevailing county laws are complied with. Property 2: ALL that parcel of land in Elk District, Mineral County, West Virginia, located between Route 42 and Secondary Route 42/4 in a community locally known as Sulphur City, more particularly described as follows, to -wit: BEGINNING at a set 5/8″ x 30″ re-bar with plastic cap in east limit of Route 42 at 20 ft. from the center thereof, corner to M. Norman Dennis, said re-bar being located S. 89-23-16 E. 13.28 ft. from original lot, corner which is now in Route 42 right of way area, thence with Dennis boundary, S. 89-23-16 E. at 113.46 ft. hitting a found iron fence post, continuing 118.72 ft. in all to a point in west limit of Secondary Route 42/4 running 15 ft. from the center thereof, S. 00-18-51 W. 46.97 ft.; S. 02-37-17 E. 69.94 ft. setting a 5/8″ x 30″ re-bar with plastic cap in the west limit of Secondary Route 42/4 at 15 ft. from the center thereof, thence with a new line of division, S. 82-27-32 W. 104.12 ft. setting a 5/8″ x 30″ re-bar with plastic cap, thence another new line of division, S. 13-40-53 W. 100.61 ft. setting a 5/8″ x 30″ re-bar with plastic cap, thence another new line of division, N 88-22-06 W. 50.45 ft. setting a 5/8″ x 30″ re-bar with plastic cap in the east limit of Route 42 at 20 ft. from the center thereof, thence with east limit of Route 42 and running 20 ft. from the center thereof, N. 13-44-42 E. 234.82 ft. to the BEGINNING, containing 0.506 acre, more or less, as shown as Parcel 1 on a plat prepared by McDowell Consulting Engineering & Surveying, as surveyed in September 1998 by Larry W. McDowell, LLS #493, (all bearings are 1998 magnetic north), said plat recorded in the Office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed Book 293, Page 836. TOGETHER WITH AND SUBJECT TO an easement appurtenant to the above described 0.506 acre tract for the benefit of the grantees herein the right to use the existing driveway or roadway now in use from State Route No. 42 over the above referenced 1.740 acre parcel conveyed unto Donald F. Parrish and Mary L. Parrish, his wife, dated and recorded as aforesaid, which easement the 1.740 acre parcel is hereby made subject to. Said right of way shall be jointly maintained by said Donald F. Parrish and Mary L. Parrish, and the grantees herein. If the grantees herein shall construct their own driveway from the above described 0.506 acre parcel conveyed herein to Route 42, this easement shall be terminated and the grantees will release the same in writing. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2465 Elk Garden Hwy., Elk Garden, WV 26717. AND BEING the same real estate which was conveyed to Shenandoah W. Snyder and Karrie L. Snyder, by Deed dated January 18, 2022, from William Mayhew, Jr. and Tomya Mayhew, and recorded in the Office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed Book 397 at Page 704. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
