The undersigned Substitute Trustee, by virtue of the
authority vested in him by that certain Deed of Trust,
dated July 9, 1997, and duly recorded in the Office
of the Clerk of the County Commission of Tyler County,
West Virginia, in Book No. 122, at Page 470 and
modified by Loan Modification Agreement recorded on August 28, 2014 in Document No. 91874 MOD, in Book No. 192, at Page 369, Donnie Smith and Katrenia A Smith did convey unto Dianne E. Theobald, Trustee(s), certain real property described in said Deed of Trust;
and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having
been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been
instructed by BRAVO Residential Funding Trust
2023-RPL1 to foreclose thereunder, will offer for sale at
public auction at the front door of the Tyler County Courthouse in Middlebourne, West Virginia, on
May 13, 2026 at 9:30 AM

thereunto belonging, situate in 02 – Ellsworth District,
Tyler County, West Virginia, and more particularly
described as follows:
The following described tract or parcel of land, together
with all improvements thereon and appurtenances
thereto, situate in Ellsworth District, Tyler County, West
Virginia, more particularly described as follows:
BEGINNING at a point in the center of Route 7 at its
intersection with Route 46, a corner of parcel two; thence two calls with the center of Route 46 and parcel
two S85-01E 63.76 feet; thence S46-23E 125.15 feet to
a point, from which a 5/8″ steel rod is N35-25E 34.00
feet; thence five calls with the center of Route 46 and
parcel four S10-48E 124.89 feet; thence S29-14E
208.81 feet; thence S23-01E 99.74 feet; thence
S10-57E 279.08 feet; thence S47-22E 51.16 feet;
thence one call with parcel five S60-39W 486.13 feet,
passing a 5/8″ steel rod at 49.00 feet and 438.13 feet, to
a point in the center of Route 7; thence six calls with
said road; N23-41E 326.41 feet; thence N6-17E 118.71
feet; thence N1-10W 98.02 feet; thence N10-41W
232.02 feet; thence N8-10W 206.43 feet; thence
N32-02W 104.05 feet to the beginning, containing 3.922
acres, more or less, as shown more completely on a
plat thereof recorded in the Office of the Clerk of the
County Commission, of Tyler County, West Virginia in
Deed Book 287, at Page 349.
This Deed is made subject to any and all exceptions,
reservations, restrictions and conveyances heretofore
given, granted, leased, reserved and excepted by the
Grantors and their predecessors in title.
At the time of the execution of the Deed of Trust, this
property was reported to have an address of: 5873
Klondike Rd, Middlebourne, WV 26149.
The referenced real estate will be conveyed with
no covenants of warranty, and subject to all covenants,
restrictions, easements, rights of way and reservations
which may be a matter of record in the aforesaid Clerk’s
Office or visible upon the ground, all prior liens and
encumbrances, including, without limitation, liens for
real estate taxes, incinerator, sanitary and sewer
charges. The purchasers at the sale shall be
responsible for paying the recording costs and also the
tax on the privilege of transferring real property (the cost
of the tax stamp to be affixed to the deed). The
purchasers shall be responsible for payment of all real
estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause
any existing tenant or person occupying the subject
property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as
deposit at the time of sale with the balance due and
payable within 30 days of the day of sale. Sale is also
subject to buyer providing Trustee with information
needed for reporting requirements required by Federal
Law including FinCen requirements (31 CFR Chapter X)
within 15 days from date of sale.
FEDERAL TAX LIEN: In the event that there are
Federal Tax Liens against the property, the United
States would have the right to redeem the property
within a period of 120 days from the date of such sale or
the period allowable for redemption under local law,
whichever is longer.
Pursuant to the Deed of Trust, the Trustee may
postpone the sale by public announcement at the time
and place designated or by posting a notice of the
same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the
right to purchase the property at such sale.
