NOTICE OF TRUSTEE’S SALE NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by Mountain Heritage Federal Credit Union, the owner and holder of said indebtedness, the undersigned Substitute Trustee see Trust Deed Book 387, at page 240 will offer for sale at the front door of the Roane County Courthouse, Spencer, West Virginia, on THURSDAY, APRIL 30, 2026, at 9:30 o’clock in the forenoon, local time, at public auction, to the highest bidder for cash, all of the right, title and interest of ROBERT W. COTTLE (now DECEASED), single, in and to the real property described in a certain deed of trust dated April 14, 2004, to RICHARD A. HUDSON, original Trustee, for the benefit of Mountain Heritage Federal Credit Union, recorded in the Office of the Clerk of the County Commission of Roane County, West Virginia, in Trust Deed Book No. 251, at page 145 thereof, possessed by the said ROBERT W. COTTLE (now DECEASED) as at the making of said deed of trust, which said real estate is situate in the District of Reedy, County of Roane, and State of West Virginia, and described in said deed of trust as follows: Schedule A – Robert W. Cottle Two tracts of land situated on the waters of Right Reedy Creek in or near the Town of Reedy in Reedy District of Roane County, West Virginia, more particularly bounded and described as follows: FIRST TRACT: BEGINNING at the Ravenswood-Spencer Pike, near an elm tree in an old line of J.N. Board land, running thence with same 4-1/2 poles to a stake in the northwest line of the B. & O. Railroad right-of-way; thence with same 10 poles; thence leaving the railroad right-of-way and running thence N 11 W, 10-1/2 poles to a stake by the side of the Ravenswood-Spencer Pike; thence with that pike about 21 poles to the place of beginning, containing three-fourths (3/4) of an acre, more or less. SECOND TRACT: BEGINNING at a stake, a corner to the Westfall lot on the north side of the railroad; thence S 14 E, 85 feet to the center of the creek; thence up the creek with the creek 190 feet to the Burgess line; thence with the Burgess line 150 feet to the corner of the Westfall lot; thence with the Westfall line and north side of the railroad to the beginning, containing one-half (1/2) acre, more or less. This is the same property conveyed by deed dated April 6, 2004 from Shane Leon Cottle, Samara E. Cottle and Joy Renea Cottle to Robert W. Cottle and Patricia Burrows, which deed will be recorded simultaneously with this trust deed. This property was previously conveyed by two deeds, as follows: (1) a deed dated August 10, 2000 from Jacqueline J. Cottle to Sandra Lynn Cottle, Shane Leon Cottle and Joy Renea Cottle, which deed is recorded in the Office of the Clerk of the County Commission of Roane County, West Virginia in Deed Book 392 at page 392, and (2) a deed dated November 19, 2003 from Sandra Lynn Cottle to Shane Leon Cottle and Joy Renea Cottle, which deed is recorded in the Office of the Clerk of the County Commission of Roane County, West Virginia in Deed Book 419 at page 394. This conveyance is made and accepted subject to the exceptions, reservations and out-conveyances of oil, gas, other minerals and easements which appear in the chain of title. The grantor covenants and represents that the grantor has no actual knowledge or reason to believe that there are any materials, substances, products or wastes of a toxic or hazardous nature, or underground storage tanks used for storing any regulated substance, located on or in this property, such that their existence violates applicable laws or regulations, or that this property was previously used for the storage, treatment or disposal of hazardous waste at any time prior to the execution of this conveyance. Upon information and belief, the Real Property address is 369 Liverpool Road, Reedy, West Virginia 25270. Sale is subject to the following terms to-wit: 1. Cash in hand on day of sale, or as the Trustee may otherwise agree. 2. Minimum acceptable bid is $34,000.00. A deposit of $2,500.00 by Bank or Cashier’s check must be delivered at the sale to the Trustee by the successful bidder as a deposit. If the Trustee is unable to convey insurable or marketable title to purchaser for any reason, but subject to the terms of this Notice and Sale, purchaser’s sole remedy is limited to refund of this deposit. Otherwise, the deposit is not refundable. 3. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon. 4. Robert W. Cottle died on March 3, 2024, and his Estate has not yet been settled. 5. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned, and further reserves the right to alter the terms of sale at any such continued sale, including, but not limited to, a lower minimum bid. 6. The undersigned reserves the right to reject any and all bids. 7. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes. 8. The premises described hereinabove, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied. 9. The undersigned may offer for sale each of the above-described tracts of land and improvements individually or may offer them together. 10. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale, which bid may include a credit bid, and is not required to pay any deposit. 11. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed. 12. Neither the owner and holder of the indebtedness secured by the underlying deed of trust, nor the Trustee shall have any duty to cause any existing tenant or persons occupying the subject property to vacate said property. 13. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim. 14. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control. 15. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
