TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 25, 2021, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 599, at Page 361, Roland Depew did convey unto Jennifer L. Morgan, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
April 30, 2026 , at 11:00 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley Bend District, Randolph County, West Virginia, and more particularly described as follows:
Those certain tracts or parcels of real estate situate in Valley Bend District , Randolph County, West Virginia, together with any and all appurtenant easements which may benefit same, and being more particularly bounded and described as follows;
TRACT ONE: Beginning at a maple tree on the south side of Files Creek at a corner of Hudson Ward farm and running N 41 E 47 feet to a white oak stump on the north side of woods; thence due north 117 feet to a stake; thence N 18 1/2 W 107 feet to a stake; thence S 84 E 180 feet to a stake; thence due south 128 feet to a stake; thence S 52 W 96 feet to a stake; thence S 61 W 105 feet to the place of beginning, containing one (1) acre, more or less.
TRACT TWO: that certain parcel of real estate containing 0.55 acres, more or less, located on State Secondary Route 37, situate in Valley Bend District, Randolph County, West Virginia, being more particularly bounded and described as follows:
Beginning at an angle iron at the end of a fence line, an original corner common to said Currence and Ralph and Ruth McCauley, thence with two (2) division lines through said Currence, S 03 58 E 130.2 feet to a corner fence post; thence S 87 46 W 165.0 feet passing a 9″ walnut, a reference, and in all 187.5 feet to the center line of State Secondary Route 37, a corner common to said McCauley and Retha V. Ward; thence with the meanders of said Route 37 for two (2) lines, S 24 35 E 42.5 feet to a point of curve, a corner common to said McCauley and said Ward; thence S 15 02 E 77.6 feet to a point in the center of said State Secondary Route 37, a corner common to said McCauley and said Ward; thence leaving said Route 37 and Retha V. Ward and running with LaDonald M. Currence for two (2) division lines, N 80 33 W 16.3 feet passing a white oak, and in all 261.17 feet to a hickory; thence N 06 35 E 209.2 feet to the place of beginning, containing 0.55 acres, as shown upon a plat attached to deed dated November 19, 1979, and of record in Deed Book 328 at page 167.
And being the same tract or parcel of real estate conveyed to Roland Depew by Rhonda L. Kidd by deed dated the 25th day of February, 2021 to be presented for recordation simultaneously herewith.
This conveyance is made subject to any and all reservations, restrictions, exceptions, covenants, agreement, rights-of-way, and easements as may be set forth in prior instruments of record in the chain of title to said real estate.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 225 Presbyterian Church Road, Beverly, WV 26253.
AND BEING the same real estate which was conveyed to Roland Depew, by Deed dated February 25, 2021, from Rhonda L. Kidd, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 615, at Page 695.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
