TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 18, 2016, and duly recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed of Trust Book 645, at Page 1, Wayne Edley Workman and Elizabeth Ann Workman did convey unto Douglas McElwee, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Jackson County Courthouse, in Ripley, West Virginia, on May 22, 2026, at 3:07 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Ripley District, Jackson County, West Virginia, and more particularly described as follows: All of those certain lots, tracts, or parcel of real estate, situate, lying and being at the intersection of U.S. Route #33 and Station Camp Road; in Ripley District, Jackson County, West Virginia, bounded and described as follows: Parcel One: Beginning at an iron stake at the edge of Station Camp Road; thence along the edge of Station Camp Road 125 feet (Deed Book 387, page 100 erroneously states 126 feet) to an iron stake; thence in a westerly direction 244 feet to the center of Station Camp Run; thence in a northerly direction down the center of Station Camp Run 125 feet; thence in an easterly direction 207 feet to the place of beginning containing 1/2 acre, more or less. W. 32 poles to a beech, another corner to Easter and in the Hogsett line; thence down the hill to the center of the Station Camp Creek, N. 33 deg. 30′ E. 10 poles to a corner to the Bailey line; thence in and along said Creek S. 72 deg. E. 23.8 poles to a point in said Creek; S. of a galvanized pipe on the north side of said Creek, this being a corner to the Bill Casto lot; thence S. 86 deg. E. 125 feet to a point on the Creek bank, 10 feet below a galvanized pipe; thence N. 26 deg. 30′ E. 14 poles and 5 links to the place of beginning, containing 4.34 acres, more or less. The above described parcels of real estate are part of the same real estate as conveyed unto Robert D. Mellen and Kelly L. Mellen, husband and wife, by Ray F. Morris and Shirley L. Morris a/k/a Shirley Morris, husband and wife, by deed dated July 10, 2006, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 387, page 100. Thereafter, by deed dated June 13, 2016, not yet of record in the aforesaid Clerk’s Office, but to be recorded simultaneously herewith, Robert D. Mellen and Kelly L. Mellen, husband and wife, conveyed the above described real estate unto Wayne Edley Workman and Elizabeth Ann Workman, husband and wife. This conveyance is subject to that certain deed dated March 13, 1970, of record in Deed Book 201, page 562, wherein Charles E. Casto and Mary F. Casto, his wife, conveyed the 4.34 acre parcel of real estate unto Ray F. Morris and Shirley L. Morris, reserving that certain gas line crossing said real estate, and the parties of the first part grant and convey unto the parties of the second part, as aforesaid, their heirs and assigns, the right to tap on to the gas line crossing the subject real estate. This conveyance is subject to that certain deed dated October 1, 1969, of record in Deed Book 200, page 439, wherein William M. Casto and Ruby Jean Casto conveyed the 1/2 acre parcel of real estate unto Ray F. Morris and Shirley L. Morris, and conveyed the right to place a gas line across the lands of Violet V. Rhodes and J. Leon Rhodes and set out the agreement that no hog pen, barn or unsightly building shall be built within 150 feet of the dwelling house on said property and the parties of the first part grant and convey unto the parties of the second part, as aforesaid, their heirs and assigns, the right of way for the gas line as described in Deed Book 200, at page 343. This conveyance is subject to the reservation of that certain now existing 20 foot wide non-exclusive right of way and easement for purposes of ingress and egress from West Virginia Route 33 to an adjoining tract of real estate containing 5.04 acres, more or less, over across and under the above tract of real estate containing 4.34 acres, and for the installation, repair, replacement, maintenance and removal of any and all utilities. There is further granted and conveyed the right to use the aforesaid 20 foot wide right and way and easement. This conveyance is made subject to all oil, gas and other mineral reservations as made by predecessors in the chain of title and to all valid and existing rights of way and easements and any and all restrictive and protective covenants appearing of record. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 81 Station Camp Road, LeRoy, WV. AND BEING the same real estate which was conveyed to Wayne Edley Workman and Elizabeth Ann Workman, by Deed dated June 13, 2016, from Robert D. Mellen and Kelly L. Mellen, and recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 467 at Page 966. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
