The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 21, 2023, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed of Trust Book 4030, at Page 153, Christopher I. Dominguez and Bessie L. Fowler did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at 400 West Stephen Street, in Martinsburg, West Virginia, on
June 8, 2026, at 10:12 AM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Martinsburg District, Berkeley County, West Virginia, and more particularly described as follows:
All that certain lot or parcel of real property, with the improvements thereon and the appurtenances thereunto belonging, identified for postal purposes as 500 E. Moler Ave., situate in the Martinsburg District, Berkeley County, West Virginia, designated and described as “Beginning at a steel pin on the southeasterly corner of the intersection of Albert Street and East Moler Avenue; thence South 23 deg. 11′ W. with the easterly side of Albert Street a distance of 87.8 feet to a point marked by a nail in the concrete; thence by a new line South 66 deg. E. a distance of 63.8 feet to a steel pin; thence by another new line N. 28 deg. 45′ East a distance of 80 feet to a steel pin on the southerly side of East Moler Avenue; thence with the Southerly side of East Moler Avenue 60 deg. W. a distance of 72.3 feet to the beginning; said parcel containing 0.13 acre, more or less,” as set forth upon that certain Survey Plat prepared by RW Ziminski, RPE, dated September 1963, and recorded in the Office of the Clerk of the County Council of Berkeley County, West Virginia, in Deed Book 222, at Page 399.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 500 E. Moler Avenue, Martinsburg, WV 25401.
AND BEING the same real estate which was conveyed to Christopher I. Dominguez and Bessie L. Fowler, by Deed dated June 21, 2023, from Jennifer E. Fuqua, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 1442 at Page 222.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
