PUBLIC HEARING NOTICE

MARTINSBURG BOARD OF ZONING APPEALS

In accordance with Chapter 8A, Article 8, Section 11 of the Code of West Virginia 2004, as amended, the Martinsburg Board of Zoning Appeals will hold a public hearing to consider the public comment on the following:

SPECIAL EXCEPTION: The property is located on Third St and identified on Berkeley County Tax Map 11 as Parcel 62. The applicant is requesting a Special Exception pursuant to Martinsburg Zoning Ordinance Table 4.01 to allow for a two-family dwelling UR-3. Case #2026-51-SE. Avanhar LLC, Avan Harris, Appellant.

SPECIAL EXCEPTION: The property is located at 704 Winchester Ave Unit A-B and identified on Berkeley County Tax Map 17 as Parcel 97. The applicant is requesting a Special Exception pursuant to Martinsburg Zoning Ordinance Table 4.01 to allow for a Child Day Care Center in UR-3. Case #2026-56-SE. Rashida Yost, Appellant.

SPECIAL EXCEPTION: The property is located off Apple Harvest Drive and Virginia Ave and identified on Berkeley County Tax Map 27 as Parcel 58. The applicant is requesting a Special Exception pursuant to Martinsburg Zoning Ordinance Table 4.01 to allow for a Drive Through Facility in MUC-3. Case #2026-57-SE. VARIANCE: The property is located off Apple Harvest Drive and Virginia Ave and identified on Berkeley County Tax Map 27 as Parcel 58. The applicant is requesting variances pursuant to Martinsburg Zoning Ordinance Section 3.08 Figure 3-9 C.1 to increase front setback and Figure 3-9 F.1 to allow front parking in MUC-3. Case #2026-58-V. Bowles Rice LLP, Chris Cox, Appellant.

A hearing will be held on the proposed variance and special exceptions on Tuesday, July 7th, 2026, at 6:30 p.m. in the J. Oakley Seibert Council Chambers at City Hall, 232 N. Queen St, Martinsburg, West Virginia. In the event that an unforeseen circumstance would cause the Board of Zoning Appeals to cancel the scheduled meeting, a back-up public hearing date of Tuesday, July 14th, 2026, will be utilized. Applications are on file in the City Planner’s Office at 232 N. Queen St.
