The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 22, 2021, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 88274316, in Book No. 2220, at Page 696, Glenard E Britton did convey unto Golden & Amos, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Union District, Wood County, West Virginia, and more particularly described as follows:
All of that certain tract or parcel of real estate located in Union District, Wood County, West Virginia, more particularly bounded and described as follows:
BEGINNING at a capped 5/8-inch by 30-inch iron rebar set in the easterly line of West Virginia Route 31 (Williamstown Pike) said iron rebar being at the common corner of Lots 4 and 5 of the hereinafter mentioned subdivision, thence with line of Lot 5 S. 82 30 00 E. 290.00 feet to a capped 5/8-inch by 30-inch iron rebar set, to the true point of beginning; thence leaving said line and with a line through the parent tract S 9 28 34 E 155.99 feet to a P.K. nail set in the line of Lot 3; thence S. 82 degrees 30′ 50″ E. 912.89 feet to a capped rebar; thence N. 07 degrees 59′ 37″ E. 148.97 feet to a capped rebar; thence with the line of Lot 5, 971.17 feet to the point of beginning, being part of Lot 4 Port View Farms Addition No. 3 and being 3.211-acres, more or less.
There is further granted and conveyed to the grantees, their heirs, successors and assigns that certain twenty-five (25) foot in width strip running parallel along and adjoining the said property described in Deed Book 1044 at page 605, in the southerly line to the remainder part of said Lot No. 4, a distance of 290 feet for roadway and utility purposes to the tract described hereinabove.
There is further granted and conveyed to the grantees, their heirs, successors and assigns that certain right-of-way described as:
BEGINNING at a point in the easterly edge of W.Va Route 31, South from the common corner of the parties hereto; thence in a northeasterly direction approximately 100 feet, more or less, to the line of the grantees, said right-of-way being 25 feet in width.
The above conveyed two rights-of-way are shown on the survey plat (of the adjacent 0.997-acre tract) which is of record in Deed Book 1159 at page 723.
This conveyance is made subject to all right-of-way, reservations, restrictive and protective covenants, utility easements, and oil, gas and mineral leases of record in the chain of title in the aforesaid Clerk’s Office.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 253 Deerwalk Hwy, Waverly, WV 26184-3336.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
