NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated October 7, 2022, executed by the Borrower, Heath Mackenzie Swisher, to Eric J. Holmes, Esquire, the Trustee, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Book 733, at Page 219. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 57 Graystone Rd., Ripley, WV 25271. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated May 26, 2026 of record in the Clerk’s Office in Book 772, at Page 965. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. The real estate herein conveyed and designated as Tract One and Tract Two is the same real estate herein conveyed unto John Manley and Kristie Manley, husband and wife, by Christopher S. Westfall and Amber R. Westfall, husband and wife, by deed dated December 15, 2009, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 409, Page 532. And also being the same real estate conveyed unto Heath Mackenzie Swisher, by John Manley and Kristie Manley, husband and wife, by deed dated October 7, 2022, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 546, Page 234. For the aforesaid consideration, there is granted and conveyed unto the parties of the second part as aforesaid, their heirs and assigns, a road right of way forty (40) feet in width which said right of way is described in the aforesaid deed dated December 29, 1988, of record in Deed Book 281 at Page 568, reference to said deed being herein made for a more particular description of said right of way. This conveyance is made subject to all oil, gas and mineral reservations as made by predecessors in the chain of title and to all valid existing rights of way and easements appearing of record.
