TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 27, 2024, and duly recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed of Trust Book 747, at Page 956, John Michael Miller and Elmer Miller did convey unto Eric J. Holmes, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Jackson County Courthouse, in Ripley, West Virginia, on July 8, 2026, at 3:17 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Ripley Town District, Jackson County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of real estate situate, lying and being in the City of Ripley, Jackson County, West Virginia, more particularly bounded and described as follows: BEGINNING at an iron pipe set from previous survey by Holley Surveying Service, said point being in the division line of Dwight Staats, now or formerly J. Howard Smith heirs, and Lovell Holstein, said point being in or near a division fence; thence along division line of said Staats, along or near said fence line, S. 84 deg. 32′ E. 52.22 feet to an iron pipe set this survey, said point being in the division line of said Staats and a corner to said Holstein and Hoyt and Goldia Crum; thence along said vision line S. 07 deg. 10′ 30″ W. 153.01 feet to an iron pipe set back of the sidewalk of U.S. Route 33; thence along sidewalk and along said highway, N. 84 deg. 00′ W. 50.00 feet to an iron pipe formerly set by Holley Surveying Service, said point being a corner to said Holstein and said Smith; thence along said division line N. 06 deg. 20″ E. 152.47 feet to the place of beginning, containing 7806 square feet, (0.179 acre), be it same, more or less, as shown upon a plat of survey prepared by Holley Surveying Service, dated September 5, 1979, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 242, Page 29. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 122 Main St. E, Ripley, WV 25271. AND BEING the same real estate which was conveyed to John Michael Miller and Elmer Miller, by Deed dated March 25, 2024, from Billie Jo Williams and Linda Lou Bever, and recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 556 at Page 29. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
