TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 20, 2009, and duly recorded in the Office of the Clerk of the County Commission of Grant County, West Virginia, in Document No. 2009007981, in Book No. 00229, at Page 00647, Betty R Brill did convey unto Mark Vieweg, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 21, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by US BANK TRUST, N.A., NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR VRMTG ASSET TRUST to foreclose thereunder, will offer for sale at public auction at the front door of the Grant County Courthouse in Petersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 4-Petersburg Corp District, Grant County, West Virginia, and more particularly described as follows:

The following described real estate, with improvements thereon, and being located and situate in Forman Addition to the Town of Petersburg, Grant County, West Virginia, and more particularly described as follows:
Tract No. 1: “The eastern portion of Lot No. 47, and all improvements thereon, situate in Forman Addition, Town of Petersburg, Grant County, West Virginia, and is more particularly described by metes and bounds as follows, to wit:
Beginning the south side of Fort Hill Avenue corner to original Schaeffer lot: thence with original line a south direction 66.8 feet to the north east corner of Lot No. 48;
Thence with line of Lot No. 48 a west course 88 feet to a stake in the north line of said lot no. 48, thence a north course crossing Lot No. 47, 62 feet to the north line of Lot No. 47 also the south line of Fort Hill Avenue; thence with said line a east course to the beginning, containing 5632 square feet, more or less.”
Tract No. 2: “The eastern end or portion of the northern half of Lot No. 48 as shown on map or plat of Subdivision NO. 2 of Forman Addition to the Town of Petersburg of record in the Office of the Clerk of the County Court of Grant County, West Virginia, in Map Book No. 1, page 5, which said eastern portions adjoins the real estate described in Paragraph 1 of this deed, which eastern portion of the northern half of Lot No. 48 is described as follows:
Beginning at the southeast corner of Lot No. 47 of said Addition and with the east line of Lot No. 48 a distance of 25 feet, thence with the lines of Lot No. 48 in a westerly direction so as to equally divide the area of Lot No. 48 a distance of 88 feet, thence in a northerly direction 25 feet to the southwest corner of the Nemor, Inc., a corporation, real estate and thence with the south line of the same 88 feet to the Beginning, containing 2,200 square feet, more or less.”
The improvements thereon being commonly known as 8 Fort Hill Avenue, Petersburg, WV 26847.
Being the same lot or parcel of ground which by Deed dated July 17, 1987 and recorded among the Land Records of Grant County, State of West Virginia, in Book 153, page 11, was granted and conveyed by and between John B. Hawse and Anna Lee Hawse, unto Betty R. Brill and
Barabara A. Hefner.
Being the same lot or parcel of ground which by Deed dated January 4, 1989 and recorded among the Land Records of Grant County, State of West Virginia, in Book 159, page 575, was granted and conveyed by and between Barbara A. Hefner, unto Betty R. Brill.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 8 Fort Hill Ave, Petersburg, WV 26847.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
