NOTICE OF SUBSTITUTE TRUSTEE SALE OF
VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 13th day of September, 2012, signed by Rick D. Bailey, to Thomas R. Ross, II, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 501, at page 49, and pursuant to a Notice of Substitute Trustee dated the 8th day of November, 2019, signed by W.L. Goddin to Gregory R. Tingler, Substitute Trustee, which is of record in the Office of the Clerk of the County County Commission of Randolph County, West Virginia in Trust Deed Book 583, at page 557, and having been requested to do so by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, the Substitute Trustee will sell at public auction at 1:00 p.m. on the
28th day of FEBRUARY, 2020
at the front doors of the Courthouse in Randolph County in Elkins, West Virginia, the following described real estate:
All that tract or parcel of land situate at the intersection of US Route 33-250 (Harrison Avenue) and North Washington Avenue, about 0.6 mile north of Downtown Elkins, Elkins Corporation District, Randolph County, West Virginia, more particularly described as follows:
Beginning at a point at the northeast intersection of said Harrison Avenue and North Washington Avenue (Deed Book 189, at Page 113), being a point in the paved street 3.8 feet south of the curb and 3.05 from the outside west corner of a catch basin, set a railroad spike, from which a power pole bears N 57* 37′ E, 11.0 feet and a 3/4 inch rebar with an aluminum cap, found, a corner to Judy the Hobbs (Deed Book 416, at Page 240), bears S 6* 14′ E, 46.01 feet, thence with the eastern boundary of said Harrison Avenue and with the east edge of a concrete sidewalk N 2* 43′ W, 69.56 feet to a point on the eastern boundary of said Harrison Avenue and at the east edge of said sidewalk, a corner to Richard Gibson (Deed Book 235, at Page 589), set a 3/4 inch by 42 inch rebar with a 2 inch diameter aluminum cap, from which the southwest corner of the Gibson house bears N 46* 41′ E, 18.97 feet, the northwest corner of the Nesbitt beauty shop bears N 79* 04′ E, 32.47 feet and the end of a concrete wall bears N 7* 48′ W. 40.5 feet, thence with said Gibson for part of a line N 63* 15′ E, 155.34 feet to a point on the western boundary of a 16 foot alley (Deed Book 189, at Page 113), a corner to Doris E. Payne (Deed Book 387, at Page 84), set a 3/4 inch by 42 inch rebar with a 2 inch diameter aluminum cap, from which an old fence post, found, bears S 63* 15′ W, 2.0 feet and the corner of a block building bears S 29* 37′ E, 1.2 feet, thence with the western boundary of said 16 foot alley S 38* 47′ E, 29.95 feet to a point at the intersection of said 16 foot alley and the northern boundary of the said North Western Avenue, set a 3/4 inch by 42 inch rebar with a 2 inch diameter aluminum cap, from which the corner of said block building bears S 48* 47′ W, 2.0 feet, a 4 inch square concrete marker with a 1/2 inch rod, found, bears S 36* 45′ E, 39.55 feet and the base of another 4 inch square marker with 1/2 inch rod, now leaning, bears N 47* 45′ E, 140.47 feet, thence with the northern boundary of said North Washington Street S 53* 02′ W, 192.98 feet to the beginning, containing 7,822 square feet or 0.18 acres, more or less, as surveyed in December, 1996, by Leon G. Mallow Professional Surveyor No. 567 and as shown on a plat of survey attached to the deed next referenced below.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights of way, easements and other encumbrances as set forth in prior instruments of record in the chain of title to said real estate.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.
TERMS OF SALE: Cash in hand on day of sale or such other terms as may be agreed upon between Substitute Trustee and successful bidder. All persons intending to be present at said time and place of sale, and intending to bid, must register with Substitute Trustee, showing a valid proof of identity and evidence of source of funds or bank letter authenticating credit availability in amounts equivalent to any proposed bid, plus costs. Purchaser shall pay all transfer tax stamps, property taxes, advertising, recording costs, deed preparation and closing costs incurred pursuant to said bid, purchase and transfer. Substitute Trustee makes no covenants or warranties, express or implied, with respect to title or fitness to this property and purchaser accepts the demised premises “as is.” If there is any part of this process of sale which is found to be objectionable, the Substitute Trustee reserves the right to cancel the sale. Substitute Trustee reserves the right to continue said sale from time to time and to reject any and all bids or offers at any time.
